YNW Melly Could Reportedly Be Released Soon Unless Officials Prove Bond Shouldn’t Be Granted

Recently, YNW Melly’s attorney Michael A. Pizzi Jr. filed a 12-page lawsuit against the Broward Sheriff’s Office. In it, he alleges that his client is being kept in inhumane conditions, including solitary confinement for around three years with no visits or phone calls. Allegedly, Melly’s lawyers have also struggled to communicate with him, been denied entry to the prison, and more. Pizzi Jr. alleges that all of this violates Melly’s first, fifth, sixth, eighth, and fourteenth amendment rights.

“We are asking a Federal Judge to Order the immediate release of Jemell Demons (a.k.a. Melly) because the Broward County jail system has been violating his Constitutional Rights,” Pizzi Jr. told XXL of the lawsuit. “The refusal to let Melly see his family and the interference on his legal representation violates the Constitution and cannot be allowed to stand and will not be allowed to stand.” Now, according to the outlet, Judge Melissa Damian has responded to the lawsuit.

Broward County Sheriff’s Office Has Until December 6 To Prove Their Case

“On or before December 6, 2024, the Respondents shall file a memorandum of fact and law to show cause why this Petition should not be granted, and shall file therewith all documents and transcripts necessary for the resolution of this Petition,” her ruling reads. If the response is not submitted by December 6, Melly could reportedly be released on bond ahead of his upcoming retrial. If they do respond, Melly has two weeks to fire back.

The Broward Sheriff’s Office shared a statement with XXL about the lawsuit, defending themselves. “The Broward Sheriff’s Office does not generally comment on pending litigation,” it begins. “However, the jail does not utilize ‘solitary confinement.’ Rather, Mr. Demons has been placed on administrative segregation, which is a classification resulting in an alternate living assignment for an inmate whose placement in the general population poses a serious threat to the safety of staff or inmates, or life and property.”

YNW Melly Demands Immediate Release Due To Allegedly “Debilitating” Jail Conditions

YNW Melly is currently behind bars awaiting his retrial, but his legal team is pushing for him to be released immediately. According to AllHipHop, his attorney Michael A. Pizzi Jr. filed a 12-page lawsuit against the Brown Sheriff’s Office earlier this week in which he alleges that the rapper is being kept in inhumane conditions. Allegedly, this includes being held in solitary confinement for roughly three years without being allowed any visits or phone calls.

The petition describes the conditions that Melly is being kept in as allegedly cruel and unusual. Pizzi Jr. alleges that they violate Melly’s first, fifth, sixth, eighth, and fourteenth amendment rights. He also alleges that Melly’s attorneys have had issues communicating with him. This allegedly includes being denied entry, being made to wait for several hours, and more.

YNW Melly Sues The Broward Sheriff’s Office For Allegedly Inhumane Jail Conditions Ahead Of Retrial

The petition also details an incident that took place in April of 2022, when another inmate allegedly falsely accused Melly of planning to escape. Allegedly, this resulted in Melly getting hit with even more communication restrictions and a full shakedown of his cell. “These restrictions are not related to any legitimate security concerns and are instead punitive measures designed to deteriorate Melly’s mental health and impede his ability to prepare for his trial,” Pizzi Jr. alleges. “No non-black inmates are subjected to such punitive restrictions.”

“The emotional and psychological toll of his prolonged isolation is enormous,” he also alleges. “The ongoing interference with his right to counsel is a blatant violation of his constitutional rights.” Melly’s retrial is currently scheduled to begin on September 10, 2025. What do you think of YNW Melly’s legal team alleging that he’s been kept in inhumane conditions behind bars? What about them requesting that he be released immediately? YNW Melly Case Takes Unexpected Turn As Lead Prosecutor Is Removed

The YNW Melly double murder retrial has taken another unexpected twist. Broward County Circuit Judge John Murphy decided to remove the lead prosecutor from the case. Assistant State Attorney Kristine Bradley, who was set to lead the prosecution, has been disqualified. Bradley took the stand and delivered a critical testimony. She revealed that she overheard Miramar Police Detective Mark Moretti, the chief investigator in the case against Demons, engage in a concerning conversation. Moretti had allegedly asked a Broward County deputy to provide false information. The info was regarding their presence during a search warrant execution outside of Moretti’s jurisdiction last October. Removing Bradley’s status as a potential witness for the defense is ultimately the fair thing to do. As her involvement could compromise her impartiality in the case. This leaves the State Attorney’s Office with a race against time to find a suitable replacement before jury selection begins.

Moreover, this decision ensures the fairness of the proceedings by preventing any perceived bias or conflict of interest. In addition, in the same ruling, Judge Murphy addressed the defense’s attempt to have the State Attorney’s Office entirely removed from the case and even dismissed entirely. However, elected State Attorney Harold Pryor and two of his deputies, who were accused of engaging in a “cover-up,” were found not to be disqualified. Judge Murphy stated that the defense failed to provide sufficient evidence to support their claims. He emphasized that all available information indicated that the prosecutors had instructed their team to be truthful and forthcoming with the court and the defense.

The case has captured public attention, and the legal proceedings are sure to be closely watched as they unfold. In addition to this latest update, the jurors for the retrial may remain anonymous. As HNHH previously reported, a motion was filed to protect the jurors identity so that they don’t become subject to harassment or outside influences.

The YNW Melly case revolves around the shooting deaths of two fellow rappers, Anthony “YNW Sakchaser” Williams and Christopher “YNW Juvy” Thomas. Jamell “YNW Melly” Demons, the accused, has consistently maintained his innocence. And the defense is exploring every avenue to challenge the credibility of key accusers in the trial. Prosecutors have until the end of next week to start jury selection in the retrial.

Last week, reports emerged that YNW Melly and his co-defendant, YNW Bortlen, were hit with witness tampering charges. But that’s not all. Apparently, they’ve found a new witness to take the stand. We will see what ends up transpiring during the case. There have already been a few delays ahead of the retrial. Per NBC Miami, the judge pushed back the jury selection process by a week after Melly’s attorneys accused South Florida prosecutors of committing felony obstruction of justice. His defense team alleged that prosecutors failed to disclose that the lead detective previously admitted that he’d be willing to lie during the investigation and while gathering evidence.

Melly’s attorneys asked the judge to remove the Broward County Attorney’s Office and possibly dismiss the case. The request came after Broward Office’s Assistant State Attorney Michelle Boutros testified that she overheard Miramar Police Detective Mark Moretti ask a deputy to lie after executing a search warrant outside of his jurisdiction. It seems as though Melly’s attorneys are hoping for a better outcome during the retrial. We’ll keep you posted on anymore updates surrounding YNW Melly’s case. YNW Melly Arraigned On Witness Tampering Charges In New Video: Watch

YNW Melly is currently in the midst of a difficult trial. Overall, he has been in custody for the better part of five years. Although his first go-around was considered a “mistrial,” he now has to do it all over again. On October 9th, jury selection will begin. The first time around, jury selection took a very long time. Consequently, there is a belief that it will be yet another lengthy process that could prove to be very cumbersome. His lawyers are sounding the alarm, and they believe the case should be dismissed, altogether.

Unfortunately for YNW Melly and his co-defendant, YNW Bortlen, things have taken a drastic turn this week. Bortlen’s home was raided by the authorities, and he was subsequently brought up on witness tampering charges. The following day, Melly was brought up on similar charges, much to his chagrin. Now, according to Bryson “Boom” Paul, we have footage of Melly’s appearance in “Bond Court.”

Melly’s attorney was adamant that there is no probable cause here and that the charges don’t make much sense. However, it does not seem like the charges are going away, in any reasonable capacity. Instead, a woman in the video can be heard saying “No Bond.” Needless to say, this is another charge in which Melly will not be able to seek any freedom. For now, he is stuck in jail, and that process could continue to play out for months as his second trial will begin quite soon.
