Jamie Foxx reflected on his infamous “medical complication” while speaking at the Critics Choice Association’s Celebration of Cinema and Television: Honoring Black, Latino and AAPI Achievements at the Fairmont Plaza Hotel in Los Angeles on Monday night. I cherish every single minute now, it’s different, I wouldn’t wish what I went though on my worst enemy because it’s tough when it’s almost over, when you see the tunnel. I saw the tunnel, I didn’t see the light. It was hot in that tunnel too, I don’t know where I was going. ‘S–t, am I going to the right place?’”

Hollywood superstar Jamie Foxx has found himself caught in the web of the Adult Survivors Act (ASA). Between his unspecified medical emergency earlier in the year, and the lawsuit he now faces, Foxx has certainly had a turbulent 2023. Without a doubt, the ASA has shaken up the entertainment, sports, and even the country’s political industry. The legislation was enacted on November 24, 2022, and is meant to last a one-year period. Within that time, victims of sexual assault would be able to file a lawsuit against their alleged abusers. As long as they were 18 or older at the time of their abuse claims, they could sue their alleged abusers no matter how long ago they were abused.
Notably, over 2,500 lawsuits were filed under the ASA while it was active. However, there was a noticeable surge in the number of lawsuits filed within the act’s final weeks. Celebrities and politicians, including Cuba Gooding Jr., Jimmy Iovine, and Andrew Cuomo, among others, were hit with lawsuits. Jamie Foxx, too, was accused of sexual misconduct under the ASA before it expired. Foxx has since denied the claims.
On November 22, 2023, two days before the ASA’s deadline, Foxx was sued for sexual assault by an anonymous woman. The complaint was filed at the New York Supreme Court and alleges that the victim was assaulted at a rooftop bar in 2015. In detail, the incident allegedly happened at Catch NYC in August 2015, according to documents obtained by PEOPLE. The lawsuit details the events of that night, and how the actor allegedly sexually assaulted the victim.
The woman has chosen to remain anonymous and will be referred to as Jane Doe. The suit alleges that she saw Mark Birnbaum, a co-founder of the establishment, having drinks with Foxx “one table away.” Afterward, at approximately 1:00 a.m., she claims to have walked up to the actor, accompanied by her friend, to ask for pictures with him. According to the suit, he replied, “Sure baby, anything for you,” after which he took “several photographs” with her.
The Incident
The suit contains claims from the alleged victim that Jamie Foxx “seemed intoxicated.” According to the document, he began to make moves on Jane Doe. She claims that he passed several comments, including “Wow, you have that supermodel body,” “You smell so good,” and “You look like Nickie.” He allegedly clarified that “Nickie” was Gabrielle Union after Doe asked him who that was.
In time, Foxx allegedly grabbed her by the arm and pulled her to the back area of the rooftop bar. She said that it was at this back area that Jamie Foxx sexually assaulted her. As soon as they reached a secluded area, Foxx “placed both of his hands on her waist, moved them under her ‘crop top’ and began rubbing her breasts,” alleges the court filing. While Jane Doe claims she attempted to step away, she alleges that the actor proceeded to slide his hands into her pants. Furthermore, she claims she noticed a security guard “some distance away who saw what was happening but walked further away.”
In addition, she claims that when Foxx slid his hands into her pants, her friend came outside. Afterward, he allegedly stopped and walked towards the aforementioned security guard. In the lawsuit, the woman claims to have required medical treatment and advice. She was allegedly “injured [and] was rendered sick, sore, lame and disabled.” Furthermore, she alleges that she “was unable to pursue her usual and regular activities.” It also claims that she has had “to undergo great conscious pain.” Finally, the suit states that she “will permanently be affected by the injuries and emotional distress she incurred as a result.”
Additionally, she claims it caused her “severe emotional distress and anxiety, humiliation, embarrassment, post-traumatic stress disorder and other physical and emotional damages.” The suit alleges that Birnbaum and Catch’s employees “had knowledge of Foxx’s propensities for aggressive behavior towards females.” Furthermore, it was alleged that they also knew Foxx’s “bad disposition when consuming excessive alcohol.” Following the filing of the lawsuit against Jamie Foxx, the woman is now seeking unspecified damages.
A Spokesperson For Jamie Foxx Addresses The Lawsuit
Soon after the lawsuit was filed, a representative of the Oscar-winning actor refuted the accusations in a statement. “The alleged incident never happened. In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter. The claims are no more viable today than they were then. We are confident they will be dismissed again. And once they are, Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action.”
Subsequently, Jane Doe’s representative, Michael S. Lamonsoff responded as well. In a statement of his own, he stated, “Our client and our firm will not be intimidated by Jamie Foxx’s age-old tactic of lies and threats against survivors of sexual assault,” he said. “Thankfully, the ASA was passed, allowing our client to demand accountability for the abuse and mental anguish she had endured since the time of this heinous assault.”

A Wave of Lawsuits
The entertainment industry is facing a tidal wave of sexual assault allegations as survivors take advantage of the closing window provided by the New YorkSurvivors Statute.
Hip-hop mogul Diddy, actor Jamie Foxx, and music executive Jimmy Iovine have all been sued. Diddy is facing a second lawsuit alleging sexual assault. Joi Dickerson-Neal, a former Syracuse University student, claims that the Bad Boy Records CEO drugged and sexually assaulted her in 1991.
According to the lawsuit filed on Nov. 23, Diddy recorded the assault, and a male friend later revealed that he had seen the video. The incident left Dickerson-Neal battling severe depression and thoughts of suicide.
More Allegations
Another anonymous woman filed a lawsuit on Nov. 24 accusing Diddy and singer Aaron Hall of raping her and her friend at an event hosted by Uptown Records in 1990 or 1991. The lawsuit alleges that Hall coerced the plaintiff into having sex with the hip-hop mogul, and later, Hall forced himself onto her.
The suits were filed in the New York Supreme Court, both before the expiration of the New York Adult Survivors Act on Nov. 24, which allows adult sexual assault survivors one year to sue regardless of when the original statute of limitations expired.
Jamie Foxx Sued
In a separate lawsuit, Jamie Foxx is being sued by an anonymous woman for an incident that occurred in New York in 2015. The plaintiff claims that Foxx touched her inappropriately at a rooftop lounge and bar, placing his hands on her waist and rubbing her breasts.
She further alleges that Foxx slid his hand into her pants, and touched her genital area. The woman says she suffered physical injuries and emotional distress as a result of the assault.
Jimmy lovine Also Slammed
Interscope Records co-founder Jimmy Iovine has also been hit with a sexual assault lawsuit.
On Nov. 22, a woman, who chose to remain anonymous accused Iovine of sexually abusing, touching, and harassing her in August 2007. The lawsuit includes charges of assault and battery, as well as violations of gender-motivated violence protection laws.
No arrests or court dates have been set for any of the men involved in these lawsuits, leaving survivors anxiously awaiting justice.
The Beginning Of The End?
On November 16, Diddy’s former girlfriend, Cassie filed a $30 million lawsuit against Diddy and accused him of abuse and rape during their decade-long relationship. The Cassie vs. Diddy lawsuit would settle for an undisclosed amount the next day.
Someone close to Diddy, who also was hit with sexual assault allegations was former Bad Boy Entertainment president Harve Pierre. An anonymous woman accused Pierre of abusing his authority to exploit and assault her.
LA Reid Hit With Sexual Assault Lawsuit
In a similar vein, music executive L.A. Reid, co-founder of LaFace Records, is facing sexual assault allegations. Former Arista Records executive Drew Dixon has accused Reid of assaulting her twice in 2001.
Diddy lost out on a role in Any Given Sunday due to his inability to convincingly throw a football. According to Bill Bellamy, Diddy was director Oliver Stone’s first choice for the role of William Beaman, the team’s jaded third-string quarterback. “The first offer was out to Puffy. We have a workout at USC. There is no way you can be in Any Given Sunday if you’re not an athlete. I don’t give a f-ck what’s on your résumé. If you’re going for the quarterback, you gotta be able to throw. So they said, ‘Okay, Sean Combs. Sean, let’s go!’ He gets under the quarterback. He’s gonna be mad when I say this, thisi shit is crazy. So they said, ‘Hut!’ And he goes back. You know how you throw with your left hand, with your weak hand? That was his regular hand. They said, ‘Thank you’,” Bellamy said.
The role would eventually go to Jamie Foxx instead. The film was a commercial success, nearly doubling its $55M budget. Stone has also previously spoken about passing on Diddy. “[Diddy] was not really a natural athlete, so we waited him out. This film takes us back to the mid-1990s as Jeremiah O’Keefe, the owner of a funeral home, hires Willie E. Gary. O’Keefe and the Loewen Group, a more substantial funeral company, had a contract that hadn’t been honored. With Gary’s help and leadership, O’Keefe sued Loewen, and it spelled a huge judgment to the tune of $500 million dollars. However, reports also state that it was later settled for $175 million. This would also ultimately unravel all the white-collar crimes that fall through the corporate cracks.
Further, the case would spell the end of the Loewen Group, and The Burial aims to tell the tale. Albeit, much more dramatically and with Foxx standing alongside fellow icon Tommy Lee Jones, who appears as the distraught O’Keefe. “We gotta go to war,” Foxx is seen passionately delivering in a teaser provided to The Root. “‘Cause that’s what I think litigation is. Litigation is war, it’s a battle. A battle to the death, and I’m not talking about no bullshit either. I’m talking about some Jean-Claude Van Damme, ass-kicking sh*t!”
The character adds: “Now, I know y’all looking at me crazy, but that’s how I like to get. And if we don’t get crazy with these motherf*ckers—I’m telling you. This Loewen Group, they powerful. Gotta lotta money, gotta lotta influence. They have everything that we don’t. But we not gon’ let them intimidate us.”
The Burial Arrives Next Week
If you’re looking for a break from Halloween-centered features, then The Burial is for you. Considering Foxx and Jones are just two of the noteworthy talents involved, it’s set to be a hit, regardless of the season. Meanwhile, Foxx is reportedly doing voice work for Groove Tails, which focuses on a competitive street dancing circuit for mice. Furthermore, Foxx is linked to a remake of the 1968 western The Wild Bunch alongside Michael Fassbender and Peter Dinklage. Finally, Foxx is also linked to a TV series about the career of Mike Tyson. However, that remains in limbo as Tyson has objected to the casting of Foxx. Additionally, the Mail lists a ninth project – All-Star Weekend. However, that film was wrapped in 2016 and was officially shelved in 2022 over concerns about offensive content in the film.
