DaBaby’s Alleged Assault Victim Wants $2M Over Beverly Hills Attack: Report

DaBaby knows his way around a courtroom but he faces a judge more frequently than one would hope. However, it appears that certain infractions of the law continue to haunt him. Per The Blast, a Beverly Hills hotel employee sued DaBaby for an alleged assault during the holidays in 2019. The incident was captured on camera and circulated immediately online before the employee filed a police report and a lawsuit.

The alleged victim now seeks $2M, claiming the rapper inflicted emotional damage and more. The assault occurred at a Marriott Hotel in December 2019, when the alleged victim, Cristofher Pocasangren, asked DaBaby for a selfie. The rapper declined but Pocasangren took a selfie anyways, leading to a heated confrontation. DaBaby asked Pocasangren to delete the photo afterward. He obliged but the rapper allegedly followed him back to the hotel where he assaulted him.

While DaBaby claimed self-defense in that case, he’s also facing another charge named Gary Pager, who also accused the rapper of assaulting him. The incident with Pager took place in North Carolina at a rental property that he owned. In an attempt to enforce “basic rental rules.” he ended up catching a case of the beats. This case was set for April. However, DaBaby’s attorney asked to push it back in order to resolve the other case with Pocasangren. His attorney stated since the information provided in Pager’s suit could potentially incriminate his client.

“If the trial date is not continued, [DaBaby] will not be able to respond to discovery or testify without providing information that could potentially incriminate him in the parallel criminal case. The trial date must be continued to protect [DaBaby’s] Fifth Amendment rights,” the rapper’s attorney wrote in a court filing. “[DaBaby] cannot be called to testify in this matter until after his criminal case has been resolved, which will not be until October 2023, at minimum,” his attorney wrote, referring to Pocasangren’s case.  DaBaby is clearly in a bit of a bind between these two lawsuits. DaBaby Hangs With Ja Morant’s Dad Courtside

It certainly seems like it’s been a while since DaBaby has been in the headlines for good reasons. The rapper has been relatively quiet following his controversial comments at Rolling Loud in 2021.

Regardless, it appears as though the 31-year-old is still enjoying life. On Wednesday night (January 4), he was sitting courtside with Ja Morant’s dad, Tee.

In the entertaining footage, the unexpected duo are soaking in some live basketball action between Morant’s Memphis Grizzlies and the “ROCKSTAR” rapper’s team, the Charlotte Hornets.

“I got OG in here tonight. In cahoots with the refs. This my dawg right here, man. It’s up right here, you see what I’m sayin’? I got him in here tonight, I’m puttin’ pressure on these boys, man. I got Melo for 12,” boasts DaBaby.

“The refs out here acting like we playing in Memphis. Don’t put me out about it, but the refs acting like we playing in motherf*ckin’ Memphis,” he continues afterwards.

Unfortunately for DaBaby, the Grizzlies easily took down the Hornets with a final score of 131-107. Morant led the team to victory through his 23 points and eight assists, further improving their record to 24-13 on the season.

In other news surrounding the rapper, his most recent album, Baby On Baby 2, majorly undersold. According to reports, the project only sold 17,200 units in its first week. Comparatively, Baby On Baby, sold 124,000 units.

He subsequently took to his social media accounts to air out his frustration, claiming he’s being blackballed. Some artists, including Boosie Badazz also had his back. “Ain’t no way my n*gga @DaBabyDaBaby supposed to sell 16k after selling almost 150k his last first week!! he one of the BIGGEST n this sh*t!! I DONT KNOW WHATS GOING ON BUT SOMETHING IS DEFINITELY GOING ON!!” writes the “Wipe Me Down” rapper in a tweet.

DaBaby Is Feeling Like “Joc In 06” On New Single

DaBaby’s keeping a steady stream of releases coming, even during the holidays. The “ROCKSTAR” rapper returned this week with a brand new single titled, “Joc In 06.” Just before New Year, the rapper comes through with high energy on his latest single over Playboi Carti-esque production. Throughout the song, he flexes his speedy flow and witty bars across the effort.

The song also came with new visuals that show Baby and his family turning up over the Christmas holidays. The rapper dons a Santa Claus hat while surrounded by his daughter and nephew at the Christmas tree.

DaBaby has delivered a slew of new music over the past few months, even after dropping Baby On Baby 2. His latest project marked his first studio album since 2020’s Blame It On Baby, though it also spurred some controversy surrounding his status in the rap game. Baby On Baby 2 sold 17K in its first week — a stark decline from his 2020 studio album. Unfortunately, some believe that the music industry blackballed him. Due to his controversial comments at Rolling Loud in 2021, many distanced themselves from him, including major DSPs and music companies. He also revealed that the incident led to a loss of $100M in potential revenue.

Though DaBaby might have ways to go before he regains the momentum he once had, he still took a few wins in recent times. Just before the holidays, DaBaby won a $6M lawsuit due to an alleged brawl in Miami.

“Along with our client, Jonathan Kirk, we are thrilled that this federal jury, after a five-day trial, came to the same conclusion that we have maintained for almost 3 years – that these plaintiffs were attempting to use the legal system to shake down Mr. Kirk,” DaBaby’s lawyer, Drew Findling, said in a statement.

DaBaby Dodged A $6 Million Judgment For Battery And Breach Of Contract In A 2020 Lawsuit Against Him

Since his explosive debut in 2019, DaBaby has faced a plethora of lawsuits stemming from his tendency to swing first and ask questions later, but at least one of those cases is now off his plate. The Charlotte rapper received a favorable verdict in a $6 million Florida case as the jury found him not liable for battery, breach of contract, and defamation after a five-day trial, according to Rolling Stone.

The case originates from a January 2020 incident in which DaBaby was accused of assaulting a pair of Miami nightclub promoters for allegedly stiffing him on an appearance fee after he was promised $30,000 but only paid $20,000. DaBaby countersued the plaintiffs, Steve Anyadike and Kenneth Carey, for invasion of privacy and unauthorized use of name or likeness. The jury found them liable, although Rolling Stone’s report does not include any damages they may have to pay DaBaby. Criminal charges against DaBaby were dropped by Miami police in March 2020 after the victims refused to cooperate, although the rapper did spend a “weak-ass 48 hours in jail.”

The win would appear to be much-needed for DaBaby after the rough year he’s had. In October, he claimed that his homophobic faux pas at Rolling Loud Miami last year cost him $10 million in performances and sponsorships, and he was flamed in November for allegedly trying to give away tickets to a recent show since demand to see him has apparently dropped so precipitously. He also claimed he’s been blackballed by the music industry — during an interview with the biggest syndicated radio show — blaming this on his low album and ticket sales. Even lions at the zoo appeared to be over him, which has gotta suck. At least he’s got this win in court, or things would look bleak, indeed.

DaBaby and Roddy Ricch have been hit with an infringement lawsuit over their 2020 hit “Rockstar.” Copyright infringement is when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the copyright owner’s permission. To prove copyright infringement, a copyright holder must establish a valid copyright and that the original material was used illegally. The plaintiff can produce a copyright certificate or other proof showing the date the copyrighted material was created. 

A Florida producer has sued the rapper Craig Mims, who is publicly known as JuJu Beats. He claims DaBaby took the beat from his song “Selena” to create his Roddy Ricch-featuring single “Rockstar” without his knowledge. JuJu Beatz claims he sent the moment in a digital file and believes the rapper’s camp accessed the file more than 40 times between 2019 and the beginning of 2020. JuJu said he was not compensated for using his song’s beat. He claimed he’s reached out to DaBaby to settle the dispute, but the rapper won’t “cooperate or accept responsibility for blatant and willful copyright infringement.” Therefore, he is now seeking $150,000 worth of statutory damages per infringement.

Five examples of copyright infringement are illegally downloading music files; uploading someone else’s copyrighted material to an accessible web page, downloading licensed software from an unauthorized site, modifying and reproducing someone else’s creative work without making significant changes; or recording a movie in a theater.

The lawsuit states, “plaintiff provided his musical composition known as ‘Selena’ to defendants in 2019, who then used ‘Selena’ to create a sound recording entitled ‘Rockstar.’ The Defendants accessed plaintiff’s ‘Selena’ on more than 40 occasions in late 2019 and early 2020”.

 Earlier this week, Mim’s lawyer told Rolling Stone, “It is unfortunate that these types of situations occur almost daily within the music industry; the unequal balance of power and money in the industry is sometimes used to silence the real individuals who truly deserve a piece of the action and money.” He added, “It is too easy for the labels and mainstream artists and producers to cut out the ones who really matter the most, it is disheartening because there is enough money in the industry to change everyone’s lives, but the money usually ends up in the hands of the few.”
