Travis Scott Requests Dismissal From Astroworld Festival Lawsuit

Travis Scott is looking to avoid a major legal burden. Back in 2021 his Astroworld Festival in Houston became the site of a now notorious festival tragedy. As the crowd rushed the stage during Scott’s performance, tons of people were dangerously compressed with fatal results. A total of 10 people died as a result of the performance getting wildly out of hand. Subsequently, after an investigation into the incident a grand jury declined to indict Scott or anyone else with criminal charges spawning from the tragedy.

But that doesn’t mean anyone is legally off the hook. Hundreds of lawsuits were filed in the months following the festival almost all of which name Scott as a defendant. Now in a newly filed motion he’s attempting to separate himself from the proceedings. “Like any other adrenaline-inducing diversion, music festivals must balance exhilaration with safety and security—but that balance is not the job of performing artists, even those involved in promoting and marketing performances. Which only makes sense: Performing artists, even those who engage in certain promotional activities, have no inherent expertise or specialized knowledge in concert safety measures, venue security protocols, or site-design,” the motion his lawyers filed reads.

Travis Scott Seeking Release From Astroworld Festival Lawsuits

This request for removal comes just a few days after some concerning news about the tragedy leaked via court docs. They showed that one of the heads of security at the festival expressed concerns about overcrowding ahead of the tragedy. In Scott’s dismissal request they specifically mention adjustments being made beforehand in an attempt to alleviate concerns, though they obviously didn’t do enough.

Travis Scott Requested To Be Dismissed From The Astroworld Festival Lawsuit, Saying He Shouldn’t Be Responsible For Safety Or Security Concerns

After being named as a defendant in the hundreds of combined lawsuits stemming from the 2021 Astroworld Festival disaster, Travis Scott has at last asked out of future proceedings. According to Billboard, Travis’ attorney Daniel Petrocelli filed a motion to dismiss him from the suit on Monday, asserting that ensuring safety and security at live events is “not the job of performing artists” — even ones whose album tiles grace said events.

The motion reads in part, “Like any other adrenaline-inducing diversion, music festivals must balance exhilaration with safety and security—but that balance is not the job of performing artists, even those involved in promoting and marketing performances. Which only makes sense: Performing artists, even those who engage in certain promotional activities, have no inherent expertise or specialized knowledge in concert safety measures, venue security protocols, or site-design.”

Even so, the defense writes, Travis did make concessions to alleviate crowding issues when they were brought to his attention during the planning phase. “When, during festival planning, concerns arose about the risk of a stampede occurring in the festival site, the Scott defendants supported festival organizers’ efforts to eliminate that risk by agreeing to remove certain rides and other attractions at the site,” Petrocelli wrote. “Then, when the Scott defendants were told to end the show after Mr. Scott’s guest performer finished performing, they did just that—ending the show as directed.”

Travis is, of course, only one of the named defendants, which included Drake (who has also since requested dismissal from liability), Apple Music, Live Nation Entertainment, and the venue and security companies involved. The nearly 300 cases were combined into a single case in January 2022, and proceedings have have gone relatively slowly since. Scott, after a year out of the spotlight, returned to performing in 2022 and released the follow-up to Astroworld, Utopia, in summer of 2023.

The Astroworld Festival tragedy of 2021 is one of the most infamous hip-hop history moments of the decade so far, and for good reason. But even more important in the civil litigation against the rapper and Live Nation, the concert series organizers, are new reports from AllHipHop and other sources about what could’ve been prevented.

Furthermore, these new revelations indicate that Astroworld Festival’s Safery and Risk Director for 2021, Seyth Boardman, warned organizers about overcrowding before this aspect resulted in the tragedy, according to court documents reportedly obtained by AHH. Specifically, he made these claims days before they planned accommodated 50,000 festival patrons, a number that reportedly rose by 5,000 individuals on the day of Travis Scott’s concert series. In addition, these new filings reveal that organizers thought they had to account for five square feet per person due to the fire safety code. In fact, they reportedly had to hold the standard at seven square feet.

As such, this new scrutiny centers around the alleged irresponsibility displayed by Live Nation and Travis Scott by underestimating the space necessary to prevent a crowd surge or overcrowding. What’s more is that litigators specifically claim that 50,000 people fit in a space that should’ve accounted for a crowd of 34,500. Additional claims include a lack of action when it comes to folks entering the festival without a ticket and insufficient monitoring for those who needed help in the crowd. This is such a big element that prosecutors identified security breaches as a principal contributor to the disaster.

Meanwhile, there’s still significant legal action from about 4,900 patrons that seek billions of dollars in damages. Drake’s legal team still wants the court to remove him from these lawsuits despite performing that night alongside Scott, since he had no knowledge of security concerns or the festival’s organization. The Houston MC cooperated with police, and the current focus is on the safety guidelines and event planning that caused this tragedy. Drake Looking To Get His Name Off Astroworld Lawsuit, Arguing He “Wasn’t Involved In Any Planning”

The hip-hop world suffered huge losses back in November of 2021. Of course, we are referring to when at least eight concertgoers lost their lives at the Astroworld Festival. It is crazy to think that it was nearly three years ago, and that night will never be truly forgotten. There is still a lot of uncertainty surrounding it, with families still looking for some answers. However, while Drake was certainly heartbroken, he also feels that his name should be removed from the Astroworld lawsuits.

AllHipHop reports that Drake’s legal team is arguing that his lack in planning makes him not liable. Their motion reads, “Mr. Graham did not receive any security briefings, was not informed of any crowd control issues, injuries or deaths in the crowd, or any stop show orders at any time either before or during his 14-minute performance.” Furthermore, they are saying that since he was “under oath” to not having any input on planning the event, there is no reason for Drake’s name to be tied up.

Travis Scott Astroworld Lawsuits Continue To Roll In After 2nd Anniversary Of Festival Tragedy

When he first began his annual Astroworld Festival, Travis Scott definitely aspired to make it something his fans wouldn’t forget. With each passing year, the event grew substantially, though 2021 was unfortunately when it all fell apart. In November of that year, 10 attendees (aged 9 to 27) lost their lives in a massive crowd crush. Their official cause of death was declared as “compression asphyxia,” which has been compared to being crushed by a car. Scott was hit with several lawsuits as a result of the fatal chaos, and while many of those have since been settled, on Monday (November 6), another legal case against La Flame came to light.

As The Blast reports, Ceremony of Roses is taking legal action against the father of two for “substantial financial harm” caused by the Astroworld Fest. The company previously provided Scott and Co. with carnival games and other amusements for the deadly event. According to them, the “SKELETONS” artist is responsible for the lack of safety measures implemented. When all was said and done, Ceremony of Roses claims they were left with no feasible way to recoup $700K worth of out-of-pocket expenses.

The Ongoing Astroworld Lawsuits Reportedly Left Travis Scott In Questioning For Hours

Although Travis Scott will not face criminal charges in relation to the 2021 Astroworld Tragedy, the “Sicko Mode” rapper’s legal battle is far from over. According to Billboard, yesterday (September 18), Scott returned to Houston, Texas, for questioning in connection with the ongoing civil depositions.

Two sources told the publisher that the deposition lasted nearly eight hours. In a statement shared with the outlet, Scott’s spokesperson, Ted Anastasiou, addressed the matter.

“Travis Scott’s deposition is typical legal procedure,” said Anastasiou. “What is not typical is how the media continues to focus on him despite being cleared of any wrongdoing by extensive government investigations, including by the Houston Police Department. Travis is fully cooperating with the legal process while still remaining committed to his tour in support of his record-breaking album, Utopia, and his charitable efforts to support at-risk communities.”

The tragic incident, which supposedly led to thousands of injuries and nearly a dozen deaths, sparked an investigation by Congress to ensure public safety at future large-scale music events. Several families have quietly reached a settlement with Scott and the event’s promoter, Live Nation. However, Billboard revealed that there could still be upwards of 1,500 remaining active cases.

The first trial of the lawsuits is scheduled for May 6, 2024.
