Authors Protest Publishers’ Law Suit Against the Internet Archive Library

A large and growing group of authors and creative professionals including Neil Gaiman, Naomi Klein, Cory Doctorow, Alyssa Milano, Lily Wachowski, and Tom Morello have signed a letter protesting the publishing industry’s lawsuit against the Internet Archive Library. 

The Internet Archive is a digital library of internet sites and other cultural artifacts in digital form, including digital books and texts, audio recordings, videos, images and software.  The Internet Archive allows books to be borrowed through its Open Library service.   Users borrow books from Internet Archive under the Archive’s Controlled Digital Lending program, which allows users to check out books fort wo weeks or less, and only permits users to check out as many copies as the Archive physically owns.

In 2020, four publishing companies, Hachette Book Group, Inc., HarperCollins Publishers LLC, John Wiley & Sons, Inc. and Penguin Random House LLC, filed a lawsuit against the Internet Archive, claiming its Controlled Digital Lending program has infringed the publishers’ copyrights and has caused them to lose millions of dollars.  Internet Archive has countered that libraries have paid billions to the publishing industry for books, are investing tremendous resources in digitizing books, that Controlled Digital Lending is fundamentally the same as library lending and is helping ensure that readers can have access to books that libraries have bought and paid for, and is not harming the publishers.  In its response to the lawsuit, the Archive has warned that publishers “would like to force libraries and their patrons into a world in which books can only be accessed, never owned, and in which availability is subject to the rightsholders’ whim.”

Indeed, the authors who have signed on to the letter have characterized the lawsuit as one of several efforts by the publishing industry to attempt to prohibit libraries from lending e-books.  The letter states:  “Libraries are a fundamental collective good. We, the undersigned authors, are disheartened by the recent attacks against libraries being made in our name by trade associations such as the American Association of Publishers and the Publishers Association: undermining the traditional rights of libraries to own and preserve books, intimidating libraries with lawsuits, and smearing librarians.” 

The letter goes onto state that “[w]e fear a future where libraries are reduced to a sort of Netflix or Spotify for books, from which publishers demand exorbitant licensing fees in perpetuity while unaccountable vendors force the spread of disinformation and hate for profit.”

Internet Archive filed a motion in July seeking dismissal of the claims on the grounds that its Controlled Digital Lending is a non-infringing fair use of the books at issue.  The court has not yet ruled on the motion.

Prince’s Personal Photographer Loses Lawsuit Over Prince Photographs

A federal appeals court recently ruled that a marketer had an implied copyright license to distribute marketing materials that contained photographic images of the late recording artist Prince taken by Prince’s longtime photographer. 

Allen Beaulieu was Prince’s photographer from 1979 to 1984.  He shot album covers and three world tours for Prince.    In 2014 Beaulieu began working on a book of his photographs.  He hired Thomas Martin Crouse to help write stories and captions and later Clint Stockwell, who worked on scanning and storing digital copies of the photos.

In April 2016, Prince died, leading Crouse and Stockwell to expect that there would be increased interest in Beaulieu’s photographs. In May 2016, Beaulieu gave Stockwell several additional photographs to digitize for inclusion in the book. Stockwell sent an MP4 slideshow of selected photographs and a press release to several investors.

Beaulieu’s collaboration with Stockwell and Crouse fell apart, and Beaulieu demanded his photographs back.   His attorney was able to retrieve some from Stockwell’s home, but Beaulieu believed that Stockwell still retained a large number of them.  He subsequently filed a lawsuit against Crouse, Stockwell, his company, and Charles Sanvik, one of the investors who had received the slideshow and press release.

Beaulieu brought claims for conversion of his property, claiming that Crouse and Stockwell had taken possession of his photographs in a manner that wrongfully deprived Beaulieu of them.  However, Beaulieu could never provide the court with an inventory showing how many photographs he had given to Crouse and Stockwell, how many they had returned to him, or how many he alleged were still in their possession.  For this reason, the district court dismissed his conversion claim, ruling that it was too speculative as to the property he claimed to have been converted.

Beaulieu also brought copyright claims against Stockwell, alleging that Stockwell had copied his photographs without authorization when he had created the MP4 slideshow and press release.  The district court rejected this claim, finding that Beaulieu had granted an implied license to use the photographs for this purpose.   An implied license is one that is not written or given directly but which can be implied from the parties’ course of conduct.  Here, Stockwell had sent the slideshow and press release to Beaulieu ahead of time and described it as part of the book’s marketing plan.  Beaulieu had not objected, and had requested that additional publishers be contacted on his behalf.  Since Beaulieu was found to have granted an implied license for use of the copyrighted photographs through this conduct, his infringement claim was dismissed.  Beaulieu later appealed this issue, but the Eighth Circuit Court of Appeals affirmed the district court’s ruling.

Finally, Beaulieu brought a claim for tortious interference with economic advantage.  This claim requires that the “interference” must be “improper,” meaning it must be based on an act recognized by law to be wrongful.  However, because the court had already rejected the conversion claim and the copyright infringement claim, there was no “improper” action, and this claim was also rejected by the district court.

A California woman has been charged with first-degree murder after killing a man by ramming her car into him after accusing him of trying to run over a cat in the street.

Hannah Star Esser, 20, was charged with murder in the death of Victor Anthony Luis, 43, and detained on $1 million bail, the Orange County prosecutor’s office said in a statement. Authorities said that Esser was driving in the community of Cypress on Sunday night when she confronted Luis and accused him of trying to run over a cat. Esser ultimately returned to her vehicle while arguing with Victor, made a U-turn, and drove straight at him. He was pronounced dead at the scene.

There are three murder charges in California: first-degree murder, second-degree murder, and capital murder. First-degree murder in California is defined as a premeditated killing with malice aforethought. The penalty in California for first-degree murder is 25 years to life in prison.

Second-degree murder requires malice and intention; however, it does not require premeditation or deliberation before the crime. Essentially, second-degree murder in California is any murder that is not either first-degree murder, felony murder, or capital murder. The penalty in California for second-degree murder is 15 years to life in prison.

Capital Murder is “murder with special circumstances.” The penalty for capital murder can be life in prison without parole or capital punishment in California.

Orange County District Attorney Todd Spitzer said that Esser’s actions showed a complete disregard for human life,” hence the First-degree murder charge. The Orange County District Attorney’s Office will ensure that this random act of violence targeting a stranger will be prosecuted to the fullest extent of the law.”

Kimberly Edds, spokesperson for the District Attorney’s office, told the news outlet it was not “immediately clear whether a cat was involved.”

Akbar V Revists Being Slapped By Young Thug: “We Are A Family”

After getting her Twitter account suspended in the midst of a nasty feud with Cardi B and her husband, Offset, Akbar V has taken some time to address other past beef that caught her a lot of attention in the media.

During a sit-down on The Progress Report podcast, the mother of five opened up about the 2017 incident during which YSL rapper Young Thug reportedly slapped her across the face in a parking lot, and although it was undeniably a tense moment at the time, she seems to have found peace with the situation now.

“It wouldn’t just like that, we was beefing, me and that boy…” Akbar began. “I done got in fights with all of them. Y’all got to understand, like, this is a family.”

Though she seemed to be having trouble getting words out, the rapper eventually said, “Chile, we done jumped down… We done… It’s family!”

“My little cousin Slug, we done jumped him at the park, like… We are family!” Akbar continued. “We gon’ have disagreements and arguments, I’m never gon’ say like ‘Oh, he beats women,’ and all of that.”

The “Super Freaky Girl (Queen Mix)” collaborator went on to describe Thug – who she reportedly previously hooked up with – as a “good person” with a “good heart,” even with all their past drama.

“I love him,” she said of the currently incarcerated rapper, earning her some backlash down in @theneighborhoodtalk’s comment section.

“Bruh. Nah. Idgah if we really are family. You smack me we enemies! We fighting,” one user wrote. Another added, “Don’t get me wrong, she’s talented, but she want fame sooooooo bad she’s willing to go through anything with big celebrities, girl that’s not family behaviour.”

DaBaby’s New Album Far Undersells Previous Project

Things haven’t been the same for DaBaby since the North Carolina rapper stirred up controversy by making homophobic remarks on stage last year. The comments had immediate repercussions, as several festivals removed DaBaby from their lineups. But even though the heat has died down over a year later, it seems DaBaby hasn’t been able to achieve the same heights he did before the event.

Last week, the “Rockstar” rapper released his newest project, Baby On Baby 2, and it has not seen the success of DaBaby’s previous efforts. According to HitsDailyDouble, the rapper’s new album hasn’t entered the top 20, sitting at 17,200 units sold. This is a massive 86% drop in first week sales from his previous album, Blame It On Baby, which debuted at No. 1 and moved 124,000 units.

The huge difference in sales got the attention of many in the hip hop community, including DaBaby himself, who tried to spin the disappointing numbers. “Not bad for da blackballed Baby,” he wrote on social media.

DaBaby isn’t the only one who thinks he’s been blackballed. Meek Mill took to Twitter on Thursday and wrote, “They blatantly black balling da baby .. not my business but ima observer.” Boosie BadAzz echoed the sentiment. “Ain’t no way my n***a @DaBabyDaBaby supposed to sell 16k after selling almost 150k his first week. The one of the BIGGEST n this shit!! I DON’T KNOW WHATS GOING ON BUT SOMETHING IS DEFINITELY GOING ON!!”

M.I.A. Prepares For Her “MATA” Album With “Beep” Single: Listen

M.I.A.’s excitement for her sixth studio album is incredibly evident, especially after she threatened to leak the project herself if it wasn’t on streamers before September ended.

Seeing as October has officially begun and MATA still hasn’t arrived, it’s clear that the English rapper didn’t get her wish, though she did announce that the record will land on October 14th while delivering her third single so far, “Beep.”

The upbeat, rhythmic track is all about using your voice to make sure that you’re heard while staying true to yourself. It follows the arrival of previous songs like “Popular” and “The One” earlier this year.

“Next gen transcend women and men / Bring a noise, make it count, yeah do it again / Never stop, never give up, don’t pretend / Tell a friend all the rules you’re gonna bend,” M.I.A. rhymes on one of her verses.

While we didn’t hear from any collaborators on the singles, the 47-year-old previously hinted that she worked with the likes of Doja Cat and Nicki Minaj on her upcoming LP.

SOURCE SPORTS: Brooklyn Nets to Host Practice in the Park on Oct. 9

Brooklyn Nets Secure 7th Seed Ahead of Play in Tournament

On Sunday, October 9, the Brooklyn Nets will have their yearly “Practice in the Park” at Pier 2 of Brooklyn Bridge Park. With one of New York City’s most famous views serving as the backdrop, fans are allowed to watch the Nets Practice on the floor. This is the sixth time Brooklyn Bridge Park has hosted a Nets open practice.

To kick off the team’s 10 Years in Brooklyn celebration, a free public event will start at noon and feature premium entertainment all afternoon. Before the team’s Practice, the Nets will host the inaugural Brooklyn Park Classic presented by SeatGeek, a 5v5 game featuring notable celebrities and influencers, with teams coached by Nets legend Kerry Kittles and New York Liberty player DiDi Richards. This year’s Practice in the Park will feature Joey Bada$$ and Flipp Dinero musical performances.

Youth from the neighborhood will be recognized on-court following the team’s Practice, and Brooklyn Nets players will present their jerseys in person. Through the community partners of the Nets, the children have been located.

Along with performances by the Brooklynettes Dance Team, Team Hype, and The Brooklyn Nets Beats Drumline, Practice in the Park will also feature food trucks, merchandise giveaways, and more. A barbershop and interactive photo opportunities, such as a station where fans may pose in a Nets press conference setup and enter to win a year’s supply of BioSteel, will also be available on-site. Community activity will include children from the Nets Academy and a girls’ basketball showcase showcasing some of the top middle school players in the city before the team takes the court.

Naomi Osaka Attends 2022 NBA Japan Games

Naomi Osaka, a four-time Grand Slam winner and Japanese tennis prodigy, was present at the NBA Japan Games 2022 at Saitama Super Arena. She hugged Japanese Olympic skateboarder Yuto Horigome and Washington Wizards forward Rui Hachimura before the game. Hachimura was the first Japanese player ever selected in the first round of the NBA Draft.

The games featured two preseason battles between the Washington Wizards and Golden State Warriors. The Warriors won the first game Friday morning 96-87 behind 20 points and 9 rebounds from a returning James Wiseman. Hachimura added 13 points and 9 rebounds for the Wizards.

Nick Cannon Announces Birth of 10th Child, Just Over a Week After Birth of Baby No. 9

Nick Cannon is officially a father of ten. Cannon celebrated the birth of his 10th child, this one with Brittany Bell.

On Instagram Friday, Cannon made the announcement. The birth comes nine days after Cannon welcomed Baby No. 9, a daughter named Onyx Ice with LaNisha Cole. The 10th Child is a son named Rise Messiah Cannon and weighs 10 pounds.

“Another Blessing!!! As my journey on this planet becomes more and more remarkable and unfathomable, all I can do is thank God and continue to ask the Most High to order my steps,” Cannon wrote. “He has given me stewardship and dominion over a family dynamic that to some is unimaginable.

“But more importantly he has blessed me with loving individuals to guide me with care through this purposeful life. I am so indebted and grateful for the matriarch energy in my time of need.”
