A 32-year-old man named Jauquell Flagg is accused of being one of four individuals who allegedly opened fire at people from inside a stolen vehicle last year. The shooting claimed the life of 44-year-old Desmond Jones and left three others injured. Earlier this week, prosecutor Rob Moran explained New York’s case against Flagg during opening statements, per XXL. He also took the opportunity to bring up an interesting Google search Flagg allegedly conducted on his phone less than a day after the shooting.

Reportedly, he looked up what criteria a jury would need to convict someone of murder, then erased his search history. While this could certainly raise some questions, his defense attorney Shaun Chase brushed it off. Apparently, Flagg is just a big fan of YNW Melly.

YNW Melly is currently behind bars for his alleged role in the murders of two of his friends, YNW Juvy and YNW SakChaser. YNW Melly Re-Trial Delayed Again

The re-trial of YNW Melly has been delayed for a third time after the defense filed another motion to dismiss. Jury selection is now scheduled for March, which was the original start date of the second delay. There is no anticipated timeframe for the trial’s new start date. This comes after Melly’s team requested a continuance in December 2023 and waived the rapper’s right to a speedy trial. That move, presumably made to give the defense more time to prepare its case, means that there is no end in sight for Melly.

However, the stakes could also not be higher for the Florida rapper. Legal maneuvers made after his first trial ended in a mistrial mean that the threshold for a death penalty, if found guilty, has been lowered. While Melly still needs to be found guilty, the jury would only need eight votes to sentence him to death. Melly is charged with double-homicide, as well as a litany of conspiracy and witness tampering charges.

YNW Melly Tries To Block Use Of Song Lyrics

Meanwhile, Melly’s attorney is also attempting to block the prosecution from using the rapper’s lyrics as evidence. “To receive something this late in the game is just part and parcel of what they’ve been doing the entire time,” Raven Liberty said. Additionally, Liberty also noted that the prosecution had agreed as far back as 2020 that they would not use song lyrics as evidence. The admissibility of the lyrics is yet to be ruled on, especially given the latest delay in the start of the trial.

The use of song lyrics as evidence is a controversial practice. There is a Supreme Court-mandated ban on it in New Jersey and heavy restrictions on the practice in California. However, it is still allowed in the state of Florida. Additionally, it was a major point of contention in 2023. Over in Georgia, Fulton County DA Fani Willis came out as a vocal advocate of the practice. This was especially notable during her prosecuting of the YSL RICO trial involving Young Thug.

YNW Melly And YNW Bortlen Witness Tampering Charges Details Released

After a few weeks of quiet in the double murder trial of YNW Melly, there’s been a blitz of news. That started when his co-defendant YNW Bortlen was arrested last week. He’s been out on bail while Melly’s first trial was underway but was brought back into custody when new witness tampering allegations were filed against both him and Melly. Bortlen’s home was also raided in the arrest and according to his girlfriend, police took numerous electronics and also inexplicably took a YNW chain as well.

The lead detective on the double murder case is being accused once again. The ever-so-dense timeline of YNW Melly’s court battles adds another layer. The Florida rapper put in another motion for the murder of YNW Sakchaser and Juvy to be dismissed. He feels that Mark Moretti, who was already called out for “excessive force,” is up against it once more. Melly and his defense attorneys are saying prosecutors withheld evidence. This surrounds Moretti’s alleged misconduct that protected him as a witness in YNW Melly’s first trial.

YNW Melly Trial: Prosecutors Claim Rapper Has Child Porngraphy On His Cell Phone

YNW Melly was back in court on September 15. While he was primarily facing a bond hearing, a claim from the prosecution has grabbed the majority of headlines. While debating a motion regarding Melly’s cell phone, the protection petitioned Judge Murphy III to prevent the defense from taking custody of the phone. This, according to the prosecution, was due to the presence of child pornography on the phone. The images in question are allegedly images of Melly’s girlfriend at the age of 17, with Melly being 18 at the time the pictures were taken. Melly, at the time of writing, is 24 years old. Under state and federal law, any nude or sexual images of a minor, regardless of age or relation to the possessor, are considered child pornography.

However, Melly’s lawyers argued that it was disingenuous for the prosecution to retain possession of the phone because “There are thousands of pieces of data on the phone, not all of it is child pornography.” With only scant footage of the hearing released, it’s unknown how deeply the issue was discussed. Furthermore, Melly’s lawyers were adamant that it not be referred to as “child porn” on camera due to it being Melly’s girlfriend. His defense claims that the young men were killed as a result of a drive-by shooting, however, prosecutors believe he shot them from within the vehicle. If he’s convicted, he could be facing the death penalty. In July, jurors were unable to come to a unanimous decision as to whether or not he’s guilty, leading the judge to rule a mistrial.

Now, one of the jurors from the first trial has come forward, making some serious claims about the case. The anonymous juror has alleged that Melly was framed for double murder. “I believe that he didn’t do it and it wasn’t proved in court,” they explained. “This was a really bad situation of being framed.” The former juror further claims that “Melly was a very good person,” adding that he “always tried to help out people around him.”

“After that law passed, they took him straight to f*cking trial, bro. Eight-four is f*cking crazy, it’s unheard of — death is unanimous.” He expressed how he feels as though the vote is unfair, citing his own personal experiences.
