Later that month, prosecutors appealed Judge John Murphy III’s ruling to toss out multiple pieces of evidence. These included the rapper’s phone records, emails, and social media posts. They insist that the evidence is crucial in proving Melly’s alleged guilt. Prosecutors are also fighting to use a 20-minute documentary about Melly’s rise to fame as evidence. Allegedly, he’s seen holding a weapon multiple times in the doc, which briefly mentions Juvy and Sakchaser’s deaths towards the end.

The appeal could take months to go through the appellate courts, making further delays likely. In April, Melly was relocated to a new facility for the first time since 2019 in preparation for his retrial. YNW Melly Retrial At A Standstill As Prosecutors Fight To Use Documentary As Evidence

Today, YNW Melly appeared in court for a hearing in his retrial, but unfortunately, it didn’t result in any progress being made. The rapper’s defense team had filed a request to move forward with discovery, which the judge has yet to issue a ruling on. Currently, everything has been put on hold while prosecutors appeal Judge John Murphy’s decision to suppress a documentary as evidence in the trial.

The 20-minute doc is said to go over Melly’s rise to fame and was filmed just before the 2018 murders of his YNW associates, Sakchaser and Juvy. Allegedly, he’s seen holding a weapon at various points in the doc, and the murders are mentioned briefly at the very end. The state alleges that it proves Melly was at the scene of the crime. It could take months for prosecutors’ appeal to go through the appellate courts, making further delays highly likely.

YNW Melly And YNW Bortlen Witness Tampering Charges Details Released

After a few weeks of quiet in the double murder trial of YNW Melly, there’s been a blitz of news. That started when his co-defendant YNW Bortlen was arrested last week. He’s been out on bail while Melly’s first trial was underway but was brought back into custody when new witness tampering allegations were filed against both him and Melly. Bortlen’s home was also raided in the arrest and according to his girlfriend, police took numerous electronics and also inexplicably took a YNW chain as well.

Now, more details are finally emerging on how the witness tampering cases came to be. According to Bryson “Boom” Paul on Twitter, the 36-page paperwork for the charges was filed earlier today. It centers on Bortlen’s interactions with state witness Felicia Holmes. Holmes was treated as a hostile witness during Melly’s initial trial, which Paul cites as contributing to his eventual mistrial. The lead detective on the double murder case is being accused once again. The ever-so-dense timeline of YNW Melly’s court battles adds another layer. The Florida rapper put in another motion for the murder of YNW Sakchaser and Juvy to be dismissed. He feels that Mark Moretti, who was already called out for “excessive force,” is up against it once more. Melly and his defense attorneys are saying prosecutors withheld evidence. This surrounds Moretti’s alleged misconduct that protected him as a witness in YNW Melly’s first trial.

In documents obtained from AllHipHop, Melly’s team feels strongly that there has been a lot of wrongdoing during this battle. “Rather than presenting this to the defense so that [they] could have used it during the first trial, the State withheld this information. In fact, it is believed the highest levels of the State Attorney’s Office made determinations to not provide it to the defense, and secondly, not to pursue the internal affairs investigation.”

Additionally, Melly’s team also thinks they have even more evidence. “In essence, the State has intentionally done whatever it could to sanitize Detective Moretti’s actions. Although the defense has only uncovered the tip of the iceberg in this matter, this tip is sufficient for this Court to determine the Defendant’s Due Process Rights.” Melly’s retrial appears to be starting on October 9, but it was pushed back once already, so who knows if this will be a set date.

YNW Melly Trial: Prosecutors Claim Rapper Has Child Porngraphy On His Cell Phone

YNW Melly was back in court on September 15. While he was primarily facing a bond hearing, a claim from the prosecution has grabbed the majority of headlines. While debating a motion regarding Melly’s cell phone, the protection petitioned Judge Murphy III to prevent the defense from taking custody of the phone. This, according to the prosecution, was due to the presence of child pornography on the phone. The images in question are allegedly images of Melly’s girlfriend at the age of 17, with Melly being 18 at the time the pictures were taken. Melly, at the time of writing, is 24 years old. Under state and federal law, any nude or sexual images of a minor, regardless of age or relation to the possessor, are considered child pornography.

However, Melly’s lawyers argued that it was disingenuous for the prosecution to retain possession of the phone because “There are thousands of pieces of data on the phone, not all of it is child pornography.” With only scant footage of the hearing released, it’s unknown how deeply the issue was discussed. Furthermore, Melly’s lawyers were adamant that it not be referred to as “child porn” on camera due to it being Melly’s girlfriend. The full statement from Melly’s legal team was reported by Bryson “Boom” Paul. Despite this, Melly’s legal team did not deny that she was underage at the time the photos were taken. Eventually, Judge Murphy III eventually chose to defer the bond decision till a later time. Additionally, jury selection from Melly’s re-trial has been scheduled to begin on October 9.

YNW Melly Re-Trial Set To Be Messy

With the introduction of a child pornography narrative, it’s clear that the prosecution is holding nothing back during this re-trial. The State of Florida is eager to find Melly guilty after failing to overcome the doubts of the jury in his first trial. The notion that the prosecution will be more vicious this time around was also seen in several other pre-trial notions. Last month, the prosecution successfully petitioned John Murphy III to lower the threshold to give Melly the death sentence. If found guilty, the jury can vote for the death penalty with an 8-4 vote.

Meanwhile, the hearing also featured testimony from Leondra Phillips, the mother of YNW Juvy, one of Melly’s alleged victims. Phillips, in no uncertain terms, spoke out against Melly receiving bond prior to his trial. “I don’t think he should receive a bond. I do know that he is innocent until proven guilty; however, these are some serious accusations against him. He has money… I don’t want anything to happen to me or my family.
