Montana Residents File Lawsuit Against State’s TikTok Ban

Citizens of Montana are fighting back against their state’s recent legislation against TikTok. In case you missed it, Montana has become the first state in America to ban TikTok. In a Senate Bill signed on Wednesday, Montana Gov. Greg Gianforte stated his aim is to protect the private information of the residents of his state.

According to NPR, Senate Bill 419 highlights the Chinese government as a reason for the ban, citing the nation as a potential threat.

“The Chinese Communist Party using TikTok to spy on Americans, violate their privacy, and collect their personal, private, and sensitive information is well-documented,” Gov. Gianforte said.

The counter lawsuit was filed on May 17, led by Samantha Alario, Heather Dirocco, Carly Ann Goddard, Alice Held, and Dale Stout, who identify as “creators and viewers of content on TikTok.”

“Montana has no authority to enact laws advancing what it believes should be the United States’ foreign policy or its national security interests, nor may Montana ban an entire forum for communication based on its perceptions that some speech shared through that forum, though protected by the First Amendment, is dangerous,” they said in the lawsuit, according to Music Business Worldwide.

“Even if Montana could regulate any of the speech that users share through TikTok, SB 419 wields a sledgehammer when the First Amendment requires a scalpel.”

The plaintiffs argue SB419 is unconstitutional and ignores national security and foreign economic factors.

The owner of TikTok, tech giant ByteDance, denied sharing information. However, government officials highlight the records of consumers are available as the nation’s government allows for storing public records.

The ban will take effect on Jan. 1, 2024, but it is currently unclear on how it will be enforced, and is also facing opposition that the bill is unconstitutional.

TikTok Sues The State Of Montana After App Is Banned

Could TikTok be Chinese spyware? Concerns have been raised by U.S. politicians regarding the potential access of TikTok user data by the Chinese government. They fear its potential use for intelligence or propaganda purposes. However, there is currently a lack of evidence substantiating the claim that the Chinese government has obtained such information. FBI Director Christopher Wray has testified before Congress to that end. According to him, if such access were indeed occurring, it might not manifest obvious signs or indications. However, many politicians have shown support for a nationwide ban. Some states, such as Montana, have taken action to ban the app completely.

On the other hand, technology industry group NetChoice has voiced their opposition to banning TikTok. They have emphasized the potential establishment of a dangerous precedent. They argue that such a move would enable the government to prohibit any business it dislikes without the presence of sufficient evidence to support allegations of wrongdoing. Carl Szabo, the vice president and general counsel of NetChoice, underlined that the U.S. Constitution explicitly forbids lawmakers from passing laws that criminalize specific individuals or businesses. He called upon Montana Governor Greg Gianforte to veto the legislation, asserting its clear unconstitutionality. That call was unsuccessful, and the TikTok ban was signed into law and is due to take effect at the beginning of 2024.

TikTok Pickup Artist Posts Video Featuring Bianca Censori

Google lists the profession of “Gratefulboy Nue”, aka Nueskii, as “musical artist”. While it’s true that Nueskii does have a few songs out, that’s not what he’s primarily known for. A quick search leads you to a TikTok with 203,000 followers created in August 2022. Here, Nueskii posts videos of him attempting to pick up women. The account also links to a YouTube channel with 10,000 subscribers that also includes prank videos alongside the pickup artist content.

The pickup artist content creator is a relic of the 2010s, when men posting this genre of content were a dime a dozen. However, the trend found new life on TikTok. While Nueskii’s content is generic for the genre, albeit successful for the creator, one of his latest videos has gone viral due to the woman featured.

Bianca Censori Appears In Neuskii Video

On May 19, Nueskii posted a video with the caption “Yea Married To Kanye 🤨.” The 26-second video, seemingly filmed in a mall, appears to feature Bianca Censori, the current wife of Ye. The video is fairly bland, with Neuskii opening with the killer pickup line, “Yeah you’re sexy yo” (men, take notes). The two talk about where they are from. Bianca says she’s from LA and Nueskii replies that he’s from Chicago. Bianca asks what Nueskii is doing, saying there is a “pair of shorts” she wants to look at. Nueskii replies “Yeah” disinterestedly as Bianca’s phone goes off before abruptly asking “Can I get your number?.” Bianca laughs politely and replies “I’m marrieeeed” just before the video ends.

As mentioned, the video is only notable because of who Nueskii has run into. However, people in the comments of the video are convinced that there is more to the video. They base this conclusion on how “friendly” Bianca comes across in the video. Firstly, some people are just naturally very friendly. Furthermore, the burden of personal public safety for women is incredibly high. Acting in a calm and friendly manner when a male stranger shoves a phone in your face and starts hitting on you is often a way in which women behave to ensure that the individual in question does not escalate the situation. Sometimes a cigar is just a cigar and sometimes a pickup artist harassing a famous person is just a pickup artist harassing a famous person.

Montana Is the First State to Ban TikTok, Is Your State Next?

Governor Greg Gianforte signed a bill banning TikTok in Montana, making it the first state to ban the app in the U.S fully.

“Today, Montana takes the most decisive action of any state to protect Montanans’ private data and sensitive personal information from being harvested by the Chinese Communist Party,” Gianforte said in a statement.

Montana will make it unlawful for Google and Apple’s app stores to offer TikTok within the state, but will not impose any penalties on individuals using the app. The ban is to take effect Jan. 1, 2024 and is almost certain to face legal challenges.

TikTok spokesperson Brooke Oberwetter argued that the law infringes on people’s First Amendment rights and is unlawful. “We want to reassure Montanans that they can continue using TikTok to express themselves, earn a living, and find community as we continue working to defend the rights of our users inside and outside of Montana,” Oberwetter said in a statement.

The residents of Montana could easily bypass the ban by using a virtual private network, a service that prevents others from observing their web browsing. 

Some states, like Utah and Arkansas, have already enacted laws that would hinge social media use on parental consent. Similar bills are in the works in other states. Last year, California enacted a law requiring companies to beef up data protection practices for children and offer them the highest privacy settings.

Creators Of “Cuff It” Challenge Haven’t Received Beyoncé Tickets

The two creators behind the TikTok “Cuff It” challenge that went viral in August of last year have not yet received tickets to Beyoncé’s “Renaissance” tour. Users (@maycsteele) and Kaitlyn (@ogpartyhardy26) posted a video dancing to the Beyoncé track “CUFF IT,” and shortly after, thousands of users followed suit. The pair shared a video on TikTok this week, claiming that they’re waiting. “Us waiting for Renaissance tickets to be sent to us after creating the ‘cuff it challenge,’” text over the video of the users reads.

In September of last year, Beyoncé shared her favorite “Cuff It” challenge videos to her Instagram. Her story featured 25 of the singer’s top picks, including those posted by professional dancers. Beyoncé kicked off her “Renaissance” tour in support of the 2022 album in May of this year, with a performance in Stockholm, Sweden. She was joined by her eldest daughter, Blue Ivy, as well as her husband Jay-Z. The tour’s opening night led to some commotion, with the setlist leaking online prior to the show and one fan being arrested.
