Gunna’s legal team has filed a third motion for a bond hearing since his initial arrest in May in connection with the YSL R.I.C.O case.
According to WSB-TV Atlanta, in the new filing, Gunna’s lawyers argue that the new indictment from prosecutors presented no evidence to support their claims of the YSL artist being a threat if released on bond. Gunna’s attorneys state that the prosecution has failed to bring about one witness who has actually accused the Drip Season 2 artist of threatening them.
The filing reads “with the Court’s Order requiring the prosecution to reveal to the defense by September 23 any and all proffers or witness statements from gang members implicating Kitchens in any gang-related criminal conduct or threats to witnesses, the prosecution has now acknowledged that no actual information or documentation exists.”
The filing also states how a new indictment filed by prosecutors removed Gunna from a 2018 incident that involved Young Thug where the So Much Fun artist was arrested during a traffic stop after four others in the car with him were armed with high capacity magazines weapons, including an AK-47.
The motion also states how in five other instances listed by prosecutors stemming from a 2017 traffic stop, Gunna was only charged with violating Georgia’s window tint laws. All other charges against Gunna were dropped.
“Sergio Kitchens (Gunna) is very hopeful that the Court will now recognize that the discovery provided by the prosecution fails to show his pretrial release poses a significant risk of danger to any person or the community or poses a significant threat to witnesses, and accordingly grants a reasonable bond,” Steven Sadow, Gunna’s co-lead counsel, said to Complex in a statement on Wednesday.
Gunna’s legal representation is once again attempting to secure a bond for the rapper. According to Rolling Stone, Gunna’s attorneys requested a third bond motion, which highlighted the modification of the YSL indictment that removed acts of violence from his charges.
Previously bond motions were rejected by Fulton County Superior Court Judge Ural Glanville, citing the possibility of witness tampering.
Gunna’s attorney Steven Sadow said in a statement to Rolling Stone that he “is very hopeful that the Court will now recognize that the discovery provided by the prosecution fails to show his pretrial release poses a significant risk of danger to any person or the community or poses a significant threat to witnesses, and accordingly grants a reasonable bond.”
Previously, the prosecution aimed to add more evidence against Gunna, which is being challenged by his legal team.
Gunna was arrested in May and charged with a single count of conspiracy violating the RICO act. Gunna’s trial date is set for January 2023.

Gunna is once again filing another bond motion, this time arguing that there is “no evidence” to support the prosecution’s claim that he’s dangerous. Gunna was booked, along with Young Thug and 28 other members of YSL, for a 56-count Racketeer Influenced and Corrupt Organizations Act (RICO) indictment back in May.
“The State has presented no evidence to support its claims of dangerousness and has dismissed the only serious overt act (75) that was present when the first bond hearing was held,” Gunna’s legal team wrote in their request for a new hearing.
Steven Sadow, who co-leads Gunna’s counsel, explained in a statement provided to Complex on Wednesday: “Sergio Kitchens (Gunna) is very hopeful that the Court will now recognize that the discovery provided by the prosecution fails to show his pretrial release poses a significant risk of danger to any person or the community or poses a significant threat to witnesses, and accordingly grants a reasonable bond.”
Gunna is being charged with one count of Conspiracy to violate a RICO Act. If his third bond hearing is unsuccessful, he will likely remain behind bars until his January 2023 trial date.
Young Thug has also been denied a bond of his own. In total, the YSL indictment includes charges of murder, armed robbery, participation in criminal street gang activity, and more.
Gunna hopes the third time will be the charm as he files another motion for bond, saying the state has “no evidence” he’s a danger to the community. According to Complex, Gunna’s legal team says that as the “only serious overt act” in the case against Gunna dropped last month, the rapper deserves “yet another hearing on bond.” Two previous motions were denied, as prosecutors convinced a judge that Gunna would be either a flight risk or a danger to the case, with the means to intimidate or buy off witnesses or abscond entirely.
However, according to documents filed by his attorneys on September 26, “The State has presented no evidence to support its claims of dangerousness and has dismissed the only serious overt act (75) that was present when the first bond hearing was held.”
The case against Gunna, Young Thug, and the rest of YSL has been controversial from the start. Prosecutors connected the high-profile rappers to the criminal activity in the indictment against the alleged street gang mainly through their lyrics shouting out YSL — also the name of their record label — while the group’s defenders have pointed to their history of philanthropy and activism as undermining the state’s characterization of YSL as a dangerous criminal organization.
Both rappers have maintained their innocence, and have reportedly remained in good spirits throughout the ordeal. Meanwhile, bills to protect lyrics as free speech and prevent them from being used as evidence in criminal trials have gained prominence as efforts to protect Black music from being stereotyped as criminal pick up momentum nationwide.

Gunna Day is September 16 and marks the day Gunna’s Drip Closet and Goodr Grocery Store opened at his former school, Robert McNair Middle School.
On September 17, 2022, in College Park, Georgia, Gunna and Goodr will throw a family-friendly event in honor of Gunna Day that will feature rides, games, food, and merchandise for Atlanta’s Southside.
Gunna recently scored a significant career milestone when his smash song “Drip Too Hard,” which he co-wrote with Lil Baby, gathered more than 10,000,000 streams and received RIAA Diamond Certification. With over 1.55 billion streams and 950,000 records sold in the US, his eagerly awaited album DS4EVER also peaked at #1 on the Billboard 200. Gunna’s second #1 Billboard 200 debut comes with DS4EVER. Following its release in 2020, WUNNA, his most recent album, became the number one album with 113,000 equivalent album units sold and was Young Stoner Life Records’ sixth straight #1.
It has only been four years since rising Atlanta rappers Gunna and Lil Baby joined forces to drop their joint album Drip Harder, which arguably helped make them both bonafide rap stars, if not household names. Yet, in those short years, the lead single from the project, “Drip Too Hard,” has reached a high watermark fewer than 100 other songs have ever achieved: receiving a Diamond certification from the Recording Industry Association of America (RIAA). The Diamond certification marks ten million equivalent units sold. For digital awards, a unit is defined as a digital download or 150 streams.
In the history of the RIAA’s 70-year existence, only 86 songs had reached this mark before “Drip Too Hard.” Included on that list are all-time favorites like Whitney Houston’s “I Will Always Love You,” certified in January this year, “Thriller,” certified in August, and “Candle In The Wind” by Elton John. Rappers who’ve made the list include Eminem, whose 2010 single “Not Afraid” reached DIamond in June 2014, Wiz Khalifa (“See You Again,” 2019), Drake (“God’s Plan,” 2019), and Lil Nas X, whose debut single “Old Town Road” was mistakenly reported Diamond-certified less than a year after its release and later actually crossed the finish line in January 2021.
Unfortunately, only one of the two is free to celebrate their remarkable achievement. Gunna remains imprisoned, awaiting trial as he and Young Thug are accused of racketeering and other criminal activity. Meanwhile, Lil Baby is preparing the release of his third studio album, It’s Only Me, which is coming in October.
