Diddy & His Legal Team Seek Appeal After Court Denies His Release Request

The court previously denied Diddy release from jail on bond on two separate occasions in his sex trafficking case, but it looks like his legal team will continue to fight for it. Moreover, according to court documents obtained by journalist Meghann Cuniff, his lawyers filed a notice of appeal on Monday (September 30) concerning Judge Andrew Carter’s decision to deny their requests for a release under any circumstance ahead of his trial. In addition, Cuniff also reported that a new member joined Sean Combs’ legal team recently: an attorney by the name of Anthony Ricco. We will see in due time whether this appeal is a successful attempt.

According to court documents reportedly obtained by AllHipHop, Diddy’s lawyer Marc Agnifilo stated that they couldn’t do much more to get him out of Brooklyn’s Metropolitan Detention Center, which Agnifilo described as “horrific” after failed bail attempts and a failed request to move him to Essex County. “Following the September 18, 2024 court appearance, the court ordered a status update from counsel concerning any request related to the location of Mr. Combs’ detention,” the attorney expressed. “At this point, there is no request from counsel that the court take any action.”

Furthermore, the court allegedly denied Diddy’s bond due to supposed victim intimidation and bribery. Prosecutors claim that he “used his considerable wealth and influence to make victims rely on him financially, for example, by paying for their rent or their cars or by offering them career opportunities. The bail package proposed by defense counsel is insufficient because it fails to adequately protect others from the defendant’s violence, impose measures to prevent and detect obstruction, or prevent the defendant from accessing his vast resources.”

“He’s going to clear his name and we’re going to stand by his side as he does,” Diddy’s lawyer told reporters previously, per CNN. “We believe in him wholeheartedly. He came here to turn himself in. Why doesn’t the government want him to turn himself in? Because then they can’t ask for detention. All we can do is show good faith. He got on a plane and he came here. They arrested a guy who came here to turn himself in.”

Now that federal officials have arrested Diddy – and after the court denied his bond twice – many wonder how the actual trial will develop. Some, like Katt Williams, think that he will snitch on many of his colleagues to catch a break, but there isn’t anything indicating that. Others are more inclined to believe that Sean Combs and his legal team will fight tooth and nail in court to advocate for his innocence, especially given their statements as of late. Well, thanks to the new TMZ documentary on Tubi, The Downfall Of Diddy: The Indictment, we have an idea of what his legal strategy is when it comes to cooperation.

During the documentary, TMZ Studios spoke to Diddy’s lawyer, Marc Agnifilo. He said that the Bad Boy mogul will not take a plea deal in his case on charges of sex trafficking, racketeering conspiracy, and transportation to engage in prostitution. Agnifilo also remarked that he will fight this case in court not just for his individual situation, but for others who face similar obstacles. As for why the legal team will not accept a plea deal even if prosecutors offer it, he cited his client’s supposed innocence as the reason why they see no need for it.

Meanwhile, an alleged sex worker’s supposed testimony in front of a federal grand jury could result in new charges and problems for Diddy. However, we still have yet to see what this could result in. While these situations don’t seem connected at all, Sean Combs’ former bodyguard Gene Deal thinks that something fishy went down. Moreover, before the Adams indictment, Deal spoke to The Art Of Dialogue and claimed that the Southern District of New York started to investigate the Bad Boy mogul as they investigated the mayor, meaning that the former’s ties to the latter might be what caused Puff Daddy’s indictment.

“All the mayor people that he brought on, here in New York City, they all resigning,” Diddy’s former bodyguard alleged. “People ain’t gon’ tie this together, but if you look at it, you have to say because of Mayor Adams and his relationship with Diddy, it brought on the Southern District of New York to start investigating Diddy on civil lawsuits that was put against him.

It was the mayor and the politicians in New York City,” he posited. In addition, Deal alleged that federal officials “found that there was some criminal activity” after looking at Cassie and Lil Rod’s civil lawsuits against Combs, which led them to pursue criminal charges. However, all these explanations still require further elaboration in court in order to make heads or tails of them. After all, the two indictments arriving during a similar timeframe could just be a coincidence.

As such, we still have a lot of allegations and claims to wade through. Both Diddy and Eric Adams vehemently deny the accusations against them. “They want to tarnish him,” the mayor’s lawyer Alex Spiro claimed at a press conference. “They want to tarnish him in your eyes. When asked about the raids, the disgraced R&B singer supposedly called the investigation a “federal conspiracy.”

However, another interesting part of the interview was when the Death Row boss theorized as to what resources Sean Combs could benefit from or have access to for his federal trial on sex trafficking and racketeering charges.

“He’s not a dummy so he’s smart enough to work his magic,” Suge Knight said of Diddy. “On top of that, he’s been involved with the FBI for most of his career. He got powerful people. Diddy Files To Dismiss Sexual Assault Lawsuit As Federal Case Heats Up

Diddy may have a massive federal indictment to handle, but that doesn’t mean he can’t still address the other lawsuits against him for his alleged misconduct. Moreover, according to TMZ, he and his team filed a motion to dismiss Crystal McKinney’s sexual assault suit against him due to the statute of limitations for these claims expiring. For those unaware, her claims were protected by the Victims of Gender-Motivated Violence Protection Law until their expiration in 2010, seven years after the alleged incident. Bad Boy Entertainment, in addition to Daddy’s House Recording, wrote a letter responding to the suit along with Sean Combs’ lawyers.

On the other hand, Crystal McKinney’s legal team posits that a local government ordinance provided a timeframe of “reviving” this case and her claims against Diddy. However, his attorneys’ counterargument is that New York state law supersedes these local provisions, which is why they argue in favor of dismissal under the state law’s statute of limitations. In addition, the letter also claims that Bad Boy and other companies owned by its mogul can’t be defendants in this lawsuit because they did not facilitate or indirectly cause the alleged crimes in question, so a court can’t hold them accountable for them.

For those unaware of Crystal McKinney’s lawsuit from back in May, she claims that she accepted an invitation to a Men’s Fashion Week shindig at Cipriani Downtown in New York City in 2003. Here, she alleges that she met Diddy for the first time, and that he invited her to his studio afterward. Crystal accused the businessman of possibly lacing a joint, forced her to perform oral sex on him after drinking with his entourage, and then blackballed her from the modeling industry. She also revealed that she attempted suicide the next year.

Meanwhile, the Diddy case will likely continue to develop in ugly, contentious, and mysterious ways. Most of the allegations against him remain just that: allegations. As such, we all have to wait until a court of law examines the charges against the music executive and to see what happens with his other lawsuits. Many celebrities and ordinary citizens alike reacted wildly to this news, especially given how hot the topic was beforehand. Still, a lot of folks wonder why this happened now and what the actual timeline for these alleged crimes looks like, since rumors about his misconduct have always flooded his career. During an interview with the Earn Your Leisure podcast released on Thursday, September 19 (recorded on August 25), 50 Cent theorized that Sean Combs’ since-withdrawn lawsuit against liquor distributor Diageo around accusations of racism in their partnership is what sped up his legal reckoning for his alleged crimes.

“My particular experience with Beam Suntory, it was great at the beginning,” 50 Cent said of the Diddy situation. “It’s great for us to work for them. It’s not so cool when you start to own things. I made a lot of money with them, too. They did a deal that mirrored what Puffy’s deal with Diageo was for Ciroc. So, he didn’t have ownership of that at any point but he was getting a lot of money. Elsewhere in the Diddy case, his lawyer Marc Agnifilo clarified why authorities placed him on suicide watch. Apparently, this is standard procedure for high-profile inmates and is not actually a result of Combs’ actions, mindset, or expressions since the arrest.
