YNW Melly’s Prosecutors Call His Defense Team “Flawed”

YNW Melly’s retrial for double murder is coming up, but not before each side can levy accusations at each other about its previous mistrial. Moreover, his defense team claimed that prosecutors tried to cheat their way to a conviction, according to court documents obtained by HipHopDX. The specific allegations are that lead detective Mark Moretti told a Broward Country Sheriff’s deputy to falsely state their presence as he- with excessive force- executed a search warrant on the rapper’s mother. Not only that, but Assistant State Attorney Michelle Boutros accused Moretti of unethical behavior. However, an internal affairs investigation in the Miramar Police Department concluded that this contradicts her previous testimony about the detective, plus other accounts that he did nothing wrong.

Furthermore, YNW Melly’s attorneys motioned for the court to block the state attorney’s office from the case. The prosecution responded by telling Judge John H. Murphy that this move is misguided. “Defendant’s flawed reasoning and rank speculation provides no grounds to disqualify the Office of the State Attorney […] and accordingly his motion must be DENIED,” they filed. “A court should hesitate to impose the drastic measure of disqualification of Government counsel. Recusal should be granted only when necessary.”

With all this considered, Judge Murphy is expected to conclude on these and other motions in about a week. Regardless, though, there are other factors at hand that could continue to push the retrial back. For example, YNW Melly and YNW Bortlen faced accusations of witness tampering recently. These claims came straight from the state’s attorney’s office. While the Florida MC’s legal team called this a “distraction” from the prosecution’s improper behavior, this could prove crucial.

Meanwhile, the “223s” MC’s retrial was supposed to commence tomorrow (Monday, October 9). Due to these controversies and other motions, it will instead take at least one more week for it to begin. YNW Melly Insists That The State Attorney’s Office Concealed Evidence To Protect Lead Detective

The lead detective on the double murder case is being accused once again. The ever-so-dense timeline of YNW Melly’s court battles adds another layer. The Florida rapper put in another motion for the murder of YNW Sakchaser and Juvy to be dismissed. He feels that Mark Moretti, who was already called out for “excessive force,” is up against it once more. Melly and his defense attorneys are saying prosecutors withheld evidence. This surrounds Moretti’s alleged misconduct that protected him as a witness in YNW Melly’s first trial.

In documents obtained from AllHipHop, Melly’s team feels strongly that there has been a lot of wrongdoing during this battle. “Rather than presenting this to the defense so that [they] could have used it during the first trial, the State withheld this information. In fact, it is believed the highest levels of the State Attorney’s Office made determinations to not provide it to the defense, and secondly, not to pursue the internal affairs investigation.”

Furthermore, they believe this would impeach Moretti, but instead, Melly has not been granted fair Process Rights. Additionally, Melly’s team also thinks they have even more evidence. “In essence, the State has intentionally done whatever it could to sanitize Detective Moretti’s actions. Although the defense has only uncovered the tip of the iceberg in this matter, this tip is sufficient for this Court to determine the Defendant’s Due Process Rights.” Melly’s retrial appears to be starting on October 9, but it was pushed back once already, so who knows if this will be a set date.

YNW Melly Update: Alleged Victim’s Mom Asks Judge To Deny Rapper’s Bond

Even after spending four long years of his life behind bars, YNW Melly remains persistent in his quest for freedom. The Florida-born rapper was granted a mistrial while facing accusations of double murder earlier this summer. He’s currently remaining behind bars while awaiting his impending retrial. This week, Melly returned to the courthouse to make his case for bond. Understandably, the embattled entertainer wants to be in the company of friends and family until he’s potentially found guilty. Of course, not everyone wants to see the “Murder on My Mind” artist walk free – particularly not the loved ones of his alleged victims.

As AllHipHop reports, Melly had a hearing on Friday (September 15) during which Judge John Murphy overheard his legal team’s request for bail. Seeing as the 24-year-old has been accused of killing his two affiliates, YNW Juvy and YNW Sakchhaser, in 2018, it’s reasonable that there’s a reluctance to put a bond in place. Still, Melly has spent all of his 20s so far behind bars, and it’s unclear exactly when he’ll find out his fate. “I don’t think he should be granted a bond at all,” Leondra Phillips, Juvy’s mom, shared in court earlier today. If he doesn’t receive bail, Melly will likely spend the remainder of 2023 in jail. Jury selection is scheduled to begin on October 9. Following that, prosecutors are hoping to have all 12 members seated by November 2.

YNW Melly Jury: One Woman’s Hesitation To Convict Reportedly Lead To Mistrial

After watching endless chaos unfold during YNW Melly’s double murder trial earlier this summer, the Florida native was surprisingly granted a mistrial. His attorneys attempted to motion for one earlier on in proceedings and were ultimately denied. However, the jury’s failure to come to a consensus led the presiding judge to rule in Melly’s favour. Of course, this doesn’t mean he’s walking free. Rather, prosecutors will be re-trying the case again in the fall. An October court date was already set at the end of July.

Many who have been keeping up with the trial are curious as to know exactly what happened with the jury behind closed doors. Thankfully, Local 10 News finally has some answers. According to them, the majority of members were on board with convicting Melly. However, one woman in particular held her ground on defending the accused killer. “From day one, she had issues with the foreperson selected, at one point crossing her arms and saying she was ‘Done!’” another juror recalled to the outlet.

YNW Melly’s Double Murder Case Mistrial, Explained

YNW Melly’s highly publicized double murder case has officially closed for now. On Saturday, July 22, a South Florida district judge stepped in to declare a mistrial after the jury could not decide on a verdict.

Throughout the trial, several rumors flooded social media. One was that if Melly was convicted on the two first-degree murder charges, he would face the death penalty. Although capital sentencing is still practiced in Florida, that possibility, according to XXL,, was dropped for an unknown reason. However, according to Billboard, that decision was overturned by an appellate judge.

Here’s the rundown of YNW Melly’s double murder case mistrial.

Who Is YNW Melly?

YNW Melly, real name Jamell Maurice Demons, is a rapper who became prominent in 2018. Melly is most known for his songs “Murder on My Mind”; “Mixed Personalities,” featuring Kanye West; “Suicidal”; and “223’s,” featuring 9lokknine. The Florida rapper is the most famous member of the musical collective YNW, which is an acronym. Fans debate whether its true meaning is Young N**** World, Young New Wave, or Young New World. Due to his quick rise, YNW Melly secured collaborations with other prominent entertainers, including Kanye West, Kodak Black, Queen Naija, Lil Tjay, Tee Grizzley, and the late Juice WRLD.

The first documented release from YNW Melly is dated back to 2016. However, he has stated in past interviews that he began his music career earlier than that. Melly has released several projects, including 2017’s Collect Call EP, 2018’s I Am You mixtape, 2019’s We All Shine mixtape, his debut album Melly vs. Melvin that same year, and 2020’s Just A Matter Of Slime.

What Was YNW Melly Charged With?

According to The Sun-Sentinel, on February 12, 2019, Melly surrendered himself to law enforcement after he was suspected of having been involved in the October 2018 shooting deaths of his friends Anthony Williams (aka YNW Sakchaser) and Christopher Thomas Jr. (aka YNW Juvy), who were also members of his music collective.

Melly was formally charged with two counts of first-degree murder. A month before being charged, Melly’s associate Cortlen Henry (aka YNW Bortlen) was arrested in Houston, Texas, in connection to the case. Henry was later extradited to Florida, according to The Florida Times-Union.

Police alleged that Melly shot and killed Williams and Thomas. Melly, they claimed, brought in Henry to serve as the gateway driver and to assist with staging a crime scene to divert authorities’ investigation. Police also accused the pair of further damaging the crime scene to make it appear like a drive-by shooting had occurred.

Before turning himself in, Melly took to Instagram to declare his innocence, writing, “I want you guys to know I love you and appreciate every single one of y’all. A couple of months ago, I lost my two brothers to violence, and now the system wants to find justice. Unfortunately, a lot of rumors and lies are being said, but no worries, God is with me and my brother @ynw.bortlen, and we want y’all to remember it’s a YNW family. When Did The Trial Begin?

Initially, the trial was set to begin on March 7, 2022, but it was delayed. A new date of May 23, 2022, was given for the trial to start. However, continued delays pushed it back to June 6, 2022. After multiple delays, according to AllHipHop, Melly’s legal team decided to file a speedy trial request on May 26, 2022, forcing the trial to begin within 175 days.

The trial was further delayed when YNW Melly’s legal sought to remove the death penalty. Finally, jury selection commenced on April 11, 2023, with the trial beginning on June 12, 2023, and concluding on June 22, 2023.

What Was The Verdict?

After the jury was gridlocked on Friday, July 21, 2023, they were dismissed by Broward Circuit Judge John Murphy III. On Saturday, July 22, 2023, the judge returned to the courtroom, declaring a mistrial.

According to a Snapchat post by YNW Melly’s mother, Jamie King, the jury leaned more towards a not-guilty verdict. Based on the note, King alleged that more than half of the 12-person panel cast a non-guilty ballet. In the note, she wrote, “9 Not Guilty 3 Guilty it was a mistrial my son will be home God is still working.”

As per the law in Florida, the YMW Melly trial can be retried, as double jeopardy has not been floated due to the trial ending in a mistrial. Mistrial simply means the jury could not make a unanimous decision. Therefore, YNW Melly hasn’t been found guilty or innocent. Law And Crime on-the-ground correspondent Bryson “Boom” Paul noted that the prosecutor of this case, Kristine Bradley, did hint at bringing the case back to the trial. When Judge Murphy III made the ruling, she was asked what could wind up being the next steps. She replied, “Let’s set a scheduling date and start with the 90 days” — the standard for refillings.

Neither YNW Melly nor his attornies have released a statement at this time. However, when Melly was initially arrested in February 2019 on Instagram, he penned a message for fans. There are no further updates on where this leaves the case of Melly’s former co-defendant Cortlen Henry (professionally known as YNW Bortlen).
