YNW Melly, born Jamell Maurice Demons is celebrating a victory after Wednesday’s preliminary court hearing for his double murder trial.  

A judge ruled that the death penalty is no longer in question. The “Murder On My Mind” rapper’s legal team was able to remove capital punishment from the sentencing based on a technicality.

His attorneys pointed out a specific rule in Florida’s criminal procedure, stating that prosecutors must give notice of the intent to seek the death penalty. The notice was never filed.

The 23-year-old Florida native was arrested in February 2019 on two counts of first-degree murder for the killings of his friends YNW Sakchaser, born Anthony Williams and YNW Juvy, born Christopher Thomas Jr. in 2018.

Demons and his co-defendant YNW Bortlen, born Cortlen Henry, allegedly staged their deaths to look like a result of a drive-by shooting but some investigating led police officers to believe that Melly was the one who pulled the trigger. 

Florida is one of thirty states where capital punishment is legal. He could face life in prison if convicted later this year.

YNW Melly Won’t Get The Death Penalty If Convicted Of Murder

It has been a while since we last heard any updates on the still-upcoming YNW Melly murder trial, but a preliminary hearing today yielded at least some information. We now know, according to XXL, no matter what the outcome, Melly won’t see the death penalty. After hearing out both sides, the judge in the case decided that the death penalty would be off the table should Melly — real name Jamell Demons — be convicted of murdering his associates Chris Thomas and Anthony Williams.

Melly is charged with two counts of first-degree murder. Prosecutors say that he and fellow rapper Cortlen Henry shot both Thomas and Williams inside of a vehicle, then drove them to the Miramar Memorial Hospital, where they claimed they were shot in a drive-by on October 26 of 2018. After a four-month investigation, police arrested Demons and Bortlen in February 2019. Melly has remained in jail without bond since; Bortlen was released on bond in 2020 but was arrested again for a probation violation in April 2021. Melly was also denied an early release for a COVID-19 diagnosis.

Melly has since pled not guilty and the trial has been pushed back repeatedly as the defense and prosecution battle over what evidence to admit/omit and a contentious jury selection process. Melly’s mother posted about today’s ruling on Instagram, expressing thanks for the removal of the possibility of the harshest sentence.

Judge Rules That YNW Melly’s Tattoos May Be Used in Murder Trial

The state of Florida’s case against YNW Melly (Jamell Demons) may grow stronger if the prosecution has its way and the rapper’s tattoos are admitted into evidence in his murder trial.

Earlier this week, a Broward County judge presiding over the murder trial ruled that Melly’s tattoos could be photographed but has not yet ruled whether the photographs will be admissible as evidence for the prosecution. According to the prosecution, Melly’s tattoos show his alleged gang affiliation. The prosecutor alleges that Melly’s gang affiliation was the motivating factor that led to the murder of Melly’s friends Christopher “YNW Juvy” Thomas Jr. and Anthony “YNW Sakchaser” Williams in 2018.

However, among the 22-year-old’s numerous visible tattoos are two names tattooed on his neck in capital letters: “JANA” and “JAMIE.” Jamie is his mother and Jana is the mother of Anthony, one of his alleged victims. This might raise a question about why Melly would murder her son if the families were close.

Additionally, the prosecution alleges that lyrics from the rapper’s single, “Murder On My Mind,” show motive, opportunity, and propensity for the murder. However, the single dropped 18 months before he allegedly committed the murder.

Melly has been charged with two counts of first-degree murder. He faces the death penalty if convicted.
