DaBaby Wins Motion To Delay Battery Case In Which Victim Admitted To N-Word Usage

DaBaby has successfully gotten the trial for the battery lawsuit he’s facing delayed. Los Angeles County Superior Court Judge Cherol J. Nellon made the ruling, this week, telling the rapper’s new attorney, Alec Rishwain, that he will only have a brief period of time to catch up on the case. Gary Pagar, who accused Baby of beating him up and robbing him during a music video shoot in Los Angeles, filed the lawsuit back in 2021.

“While I appreciate you are new to the case, everyone else is not. So if this is going to go to trial, it’s going to go soon,” Nellon told Rishwain. “This is a 2021 case. In the whole scheme of things, I just think this case needs to go to trial.” The latest update comes after DaBaby previously pleaded guilty to attacking Pagar in the related criminal case. In doing so, he was able to avoid jail time.

DaBaby hopes that he’ll be able to submit a video of Pagar saying the n-word during the confrontation as evidence for the trial, although the plaintiff’s team has attempted to block the move. “After defendant Jonathan Kirk punched Plaintiff Gary Pagar in the face without warning, knocking out his tooth and leaving him lying on the ground bleeding profusely; and after Mr. Kirk’s associates had pushed, taunted, threatened, and spat on Mr. Pagar, stolen his phone, and vandalized his house — after these events, Mr. Pagar uttered the ‘N-word,’” they admitted, arguing it was irrelevant to the assault in question.

DaBaby’s lawyers countered: “Plaintiff admits that there is no factual dispute as to whether he yelled the ‘N-word’ to Kirk yet conveniently seeks to argue that such a racial slur is irrelevant to the claim of battery. Diddy Labels Lil Rod’s Claims “Pure Fiction” In New Motion

Diddy is fighting back against Rodney “Lil Rod” Jones’ bombshell lawsuit, in which he accuses the Bad Boy mogul of sexually harassing, drugging, and threatening him. NBC News obtained a motion from Diddy’s legal team on Monday, in which they argue to dismiss Jones’ case. His attorney, Tyrone Blackburn, originally filed the lawsuit back in February. They’re seeking damages amounting to $30 million.

The motion claims that Jones’ lawsuit is rampant with lies. “Running to nearly 100 pages, it includes countless tall tales, shameless celebrity namedrops, and irrelevant images,” it reads. Diddy’s lawyer Erica Wolff, added in a statement: “Mr. Jones’s lawsuit is pure fiction — a shameless attempt to create media hype and extract a quick settlement. There was no RICO conspiracy and Mr. Jones was not threatened, groomed, assaulted, or trafficked. We look forward to proving — in a court of law — that all of Mr. Jones’s claims are made-up and must be dismissed.” They further accused Jones of trying to “generate media hype and exploit it to extract a settlement.”

In response, Blackburn said that he hasn’t gotten a chance to read through the motion in its entirety, but reaffirmed his support for his client. “This is clearly a billing exercise by individuals who are late to the game and are attempting to fill their pockets before their client is indicted,” he said. Blackburn is also representing April Lampros, who is suing Diddy for four alleged instances of sexual assault. Diddy has already denied those claims as well.

Kenneth Petty’s Sexual Assault Accuser Pushes For Him To Face Deposition

Jennifer Hough, who is suing Nicki Minaj’s husband, Kenneth Petty, over an alleged 1994 rape, has filed a motion requesting a judge in the case increase the pressure on Petty to appear in person for a deposition. The move comes after her lawyer cut off her July 9 deposition while arguing that the questioning reached a point of harassment. Regardless, Hough says she sat down to be deposed for over six hours. The lawsuit centers around the allegation that Petty intimidated and threatened her after she refused to accept a bribe to recant her claims to help him get off the National Sex Offender Registry.

“Inexplicably, Defendant Petty did not appear for today’s deposition, and Plaintiff had to incur the cost of reserving a court report and setting aside time to prepare for the deposition. Plaintiff respectfully requests that the court force defendant Petty to pay for the cost associated with intentionally failing to appear for the deposition,” Hough’s lawyer wrote.

The filing continued: “The Plaintiff respectfully requests leave to file a motion to compel Defendant Petty to provide the outstanding document requests and appear in person for deposition. Young Thug Trial: Judge Puts Proceedings On Hold As Recusal Motion Goes Under Review

Fulton County Superior Court Judge Ural Glanville has put the trial for Young Thug and YSL on hold after the defense filed a motion for him to recuse himself over a controversial ex-parte meeting with the prosecutors and star witness Kenneth Copeland. Glanville says the trial will not resume until a separate judge reviews the case and decides whether he should continue on the bench. Additionally, he’ll be releasing a full transcript of the meeting with Copeland “so everyone will have a chance to look at it.”

The move came as a surprise to both sides of the case. When the prosecution asked how long this will take, Glanville replied: “I don’t know. I don’t have anything to do with that.” The criminal trial has already become the longest-running in Georgia history, going on 18 months with no end in sight.

He accused the judge of working with the prosecution to allegedly coerce Copeland into testifying. In turn, Glanville placed him under arrest for contempt of court and took offense at the suggestion.

Megan Thee Stallion Wants Ex-Cameraman’s Sexual Harassment Lawsuit Dropped

In April of this year, Megan Thee Stallion’s former cameraman Emilio Garcia filed a lawsuit against the hitmaker, accusing her of sexual harassment and labor code violations. He alleged that she made him watch a sexual encounter between her and another woman on a 2022 trip to Ibiza. He was fired the following year. Meg and her team previously denied the allegations and are now looking to get the lawsuit dropped. According to court documents obtained by legal reporter Meghann Cuniff, she filed a motion for dismissal yesterday (June 25).

Meg’s team argues that Garcia should’ve filed his suit in New York instead of California, where neither of them are residents. “This case involves an alleged incident that occurred out of the country, an out-of-state plaintiff and an out-of-state defendant with no minimum contacts with California,” her lawyers wrote. “Defendant Megan Thee Stallion (Megan Pete or ‘Ms. Pete’) is a citizen of Florida. Plaintiff Emilio Garcia is a citizen of Texas. By Plaintiff’s own admission, his false tort claims against Ms. Pete arise from conduct that purportedly occurred in Ibiza, Spain.”

YNW Melly Wants YNW Bortlen & His Girlfriend’s Phone Calls Excluded From Retrial

YNW Melly has been behind bars since 2019 when he was arrested and accused of murdering two of his associates, YNW Juvy and YNW Sakchaser. The rapper was charged with two counts of first-degree murder, and first went on trial last summer. It was ruled a mistrial after the jury failed to come to a unanimous decision. If convicted, he faces life in prison or the death penalty.

Now, he continues to await his retrial, which was initially slated for October of last year. It’s since seen multiple delays. It remains unclear exactly when he’ll be retried, but in the meantime, his attorneys have been hard at work. Earlier this week, for example, his team filed a motion to exclude his co-defendant YNW Bortlen’s phone conversations with his girlfriend Juneviah Molina from the upcoming retrial.

According to them, the conversations between Bortlen and Molina include nothing but “small talk.” His attorneys claim they’re “irrelevant, inadmissible hearsay, and lack an evidentiary basis to be used against” Melly. Their motion also argues that YouTube videos featuring 1090 Jake should be prohibited. Since December of last year, prosecutors have been fighting to use Melly’s phone records, emails, and social media posts as evidence in the upcoming retrial. They’re also looking to use a 20-minute documentary about his rise to fame. Allegedly, it shows him holding a weapon at various times and briefly mentions the deaths of Juvy and Sakchaser.

Last month, Melly was moved to a new facility for the first time since his 2019 arrest, and now resides at the Paul Rein Detention Facility in Pompano Beach, FL. He’ll remain there until the retrial. It’s no secret that Diddy’s been wrapped up in a great deal of legal problems as of late. Two of the mogul’s mansions were raided by Homeland Security last month, putting him and his family up for more public scrutiny than ever.

Now, in one small attempt to fire back, his legal team filed a motion earlier this week to dismiss some of the claims made in Joi Dickerson-Neal’s lawsuit. She accuses Diddy of drugging and sexually assaulting her in 1991 and filed her suit in November. His team is arguing that he can’t be sued for allegedly breaking laws that weren’t in place at the time.

Diddy Dismisses Ex-Nanny’s Move To Sanction Him In New Lawsuit Motion: Report

Diddy’s legal trouble turned much nastier this year thanks to accusations of sexual assault, and his other lawsuits still rage on. Moreover, a new development emerged in his ex-nanny Raven Wales-Walden’s case against him for alleged wrongful termination, according to court documents obtained by Radar Online. Specifically, she claimed that Sean Combs and his team refused to provide important legal documentation in this case, asking for compensation in the form of $5,000. “Defendants have been completely evasive in their discovery responses,” Wales-Walden’s lawyer stated concerning this aspect. He provided this paperwork, but blasted these moves in court via his legal representative.

“Instead of filing the Motion and wasting Court and party resources, [Raven] should have consulted with [him] on a production schedule in order to understand when they would be producing the documents they committed to,” Diddy’s affiliate expressed. “Sanctions are not warranted under these circumstances, the documents sought have been produced. The Motion was irrelevant to [Diddy’s] production, and [Raven’s] counsel manufactured a dispute that did not exist.” What remains now is to see whether the court will ask for more from these documents or instead become more cautious with Wales-Walden’s requests.

According to him, Wales-Walden did not “satisfactorily perform her job responsibilities, and otherwise conduct herself in accordance with the standards and policies of Combs Defendants.”

Meanwhile, the Bad Boy mogul alleged that he acted through “reasonable steps to prevent and correct workplace discrimination (if any) and to implement internal grievance processes designed to respond to, correct, remedy, or otherwise avoid the alleged harm, if any. [Raven] unreasonably failed to utilize the preventive and corrective measures that the Combs Defendants provided. Reasonable use of such procedures would have prevented at least some of the harm (if any) that [Raven] alleges to have suffered. [She was] not performing all of her job duties as required. There were some days that [Raven] received compensation for work that [she did] not perform.
