Nike Files Lawsuit Against BAPE For Copying Sneaker Designs

Nike has taken the next move in coming after companies who they claim have copied their shoe designs. Last year they filed lawsuits against Kool Kiy and Omi for copying the design of the Jordan 1 and Dunk, and now, they are taking aim at BAPE for stealing multiple shoe designs.

Many have wondered since BAPE started selling the Bapesta sneaker, a clear derivative of the Air Force 1, why Nike never took legal action against them. A little over 20 years after the Bapesta was first released, on Wednesday, Nike filed a formal lawsuit against BAPE for copying many of their designs.

In a graphic chart, Nike showed the blazing similarities between their trademarked silhouettes and the different sneakers produced by BAPE. The graphic shows the comparisons between Bape’s Bape Sta and the Air Force 1, the Bape Sta Mid and the Air Force 1 Mid, the Sk8 Sta and the Dunk, Court Sta High and the Air Jordan 1, and Court Sta and the Air Jordan 1 Low.

As for why it took 20+ years to file a lawsuit against BAPE, Nike said that they met with BAPE in 2009 to discuss the designs which resulted in BAPE closing most of its U.S. stores and diminishing its presence in the U.S. market. The Bapesta was redesigned in 2016 to less resemble the Air Force 1, but was re-released in 2021 as the original version. That’s when Nike decided to formally take legal action against BAPE.

It’s still January, and sneakerheads are already looking ahead to Christmas releases. Jordan Brand is rumored to bring back a special edition of the Retro 11, the Defining Moments Pack edition.

The DMP Retro 11 first appeared in 2006 alongside the Retro 6 of the same name. The Retro 11 is reminiscent of the original Concord 11, bringing in Gold elements, specifically to the Jumpman logo and heel tag. Sneaker source ZSneakerHeadz detail that the sneaker will arrive this Holiday season with a $225 price tag.

The news of the sneaker comes after dissapointemnt of a potential re-release of both the Columbia and Gamma colorways of the Retro 11 being nixed. Additional sneakers being released this year in a stacked year for Jordan BRand include White Cement 3s, Thunder Retro 4, Wheat Jordan 13, and Playoff 13.

Adidas Loses Lawsuit Against Luxury Brand for Using Stripes in Designs

Luxury designer Thom Browne won a suit in a trademark infringement lawsuit filed by Adidas. A New York jury rejected Adidas’s claim that Brown’s three-striped designs were too similar to the company’s. 

Trademark infringement is the unauthorized use of a trademark or service mark. This use can be in connection with goods or services and may lead to confusion, deception, or a misunderstanding about the company a product or service came from. Trademark owners can take legal action if they believe their marks are being infringed. If an infringement of a trademark is proven, a court order can prevent a defendant from using the spot, and the owner may be awarded monetary relief. 

In the lawsuit, Browne’s defended his design by arguing that the two companies are not direct competitors and do not serve the same consumer market. According to the Associated Press, the dispute goes back 15 years. After Browne agreed to shift to a four-stripe design, Adidas did not argue. However, as Browne became more prominent after the 2018 sale, he began expanding further into activewear, and the sportswear giant took notice.’  

Adidas claimed that Browne tried to imitate their logo “in a manner that is likely to cause consumer confusion and deceive the public.” Browne had already agreed to add a fourth stripe to end any confusion potentially. However, the court ruled that the stripes were a common design.

The lawsuit went to trial last week, with Adidas seeking $867,225 in damages and another $7 million that it claimed was equivalent to Thom Browne’s profit. The two-week trial concluded when the eight-person jury returned its verdict in less than two hours. In his closing argument, Thom Browne’s attorney argued that consumers don’t confuse the two brands: Adidas is a sportswear company, while Thom Browne is a fashion house.

Adidas said it plans to appeal the ruling. “We are disappointed with the verdict and will continue to vigilantly enforce our intellectual property, including filing any appropriate appeals,” a spokesman said.

The concept of a pre-game runway served as the inspiration for the new collection, which features knitted fabrics, an allover monogram design, and a luxurious upcycled look. The T7 tracksuit with PUMA x Dap logo mania, two tees, and a reversible padded jacket with Dap’s striking representation of the PUMA, rhinestones, and the collaborator’s logo are all included in the collection. The legendary Clyde sneaker from PUMA is also given a makeover. In typical Dapper Dan fashion, he drew inspiration from his Harlem roots for this follow-up release, thinking back on the value of the expression and what that has meant to him over the years. The limited edition items will cost between $70-$300 USD.

“I did to fashion what hip hop did to music, what jazz did to music, what we’ve always done to music,” Dapper Dan said.

On launch day, Dapper Dan will tour a few retailers with this five-piece capsule collection while driving a freshly wrapped Dapper Dan vehicle. Additionally, he added the PUMA x Dapper Dan print to the interior of the PUMA jet.

End of An Era: Eastbay to Shut Down Before 2023

Iconic sneaker and sportswear retailer Eastbay will shut down this week. Shoppers are directed to take their interest to Champs Sports in a message on the Eastbay homepage.

“We’re saying goodbye to Eastbay at the end of December 2022. We encourage you to shop at champssports.com to find great deals for your athletic shoes, clothing, and more,” a message on the FAQ page reads.

Wisconsin Public Radio notes 210 workers will be laid off as a part of the closure. Eastbay began in 1990 by creating its own line of clothing before evolving into team paraphernalia and sneakers from brands like Nike, Adidas, Converse, and more.
