Homeland Security Denies Leaking Diddy & Cassie Footage After Lawyer’s Accusations

The federal case against Diddy for alleged sex trafficking and other charges became a pretty contentious court affair when his lawyer Marc Agnifilo accused the federal government of allegedly leaking the footage of him assaulting Cassie in 2016 to the press. Specifically, he accused the Department of Homeland Security of this move. Not only that, but the attorney also alleged that the government leaked other grand jury information, used excessive force in their raids on Sean Combs’ homes, and he sought to launch an investigation into the matter. Thanks to alleged email exchanges reportedly obtained by AllHipHop, we now have the feds’ answer to these allegations.

“The Government did not possess the video published by CNN prior to its public release, and the Government possessed no surveillance video at all from the Intercontinental prior to CNN’s public broadcast,” Assistant U.S. Attorney Emily Johnson reportedly stated concerning this Diddy allegation. “Accordingly, we wish to advise you that we consider any assertion in your motion of a purported Government leak related to the Intercontinental surveillance video to lack a good faith basis.”

“I don’t believe you can possibly know what DHS agents did and did not do in regard to this videotape,” Diddy’s lawyer allegedly responded. “We are making it very clear that we believe the U.S. Attorney’s Office was not involved in the leak. However, I don’t feel the same way about DHS. […] We reached out as a gesture of good faith and because we genuinely want to know your perspective. […] While you can speak from a position of knowledge in regard to your office, I don’t believe you can do so in regard to the agency.”

“To be clear, to our understanding, DHS did not have possession of the videotape prior to CNN’s publication of it,” Johnson responded to Diddy’s defense team. “Only the Government has authority to obtain grand jury material, and the video broadcast by CNN was not obtained through grand jury process.” As such, it seems like this is an allegation that Marc Agnifilo will have to argue even further in court if he wants to revisit these alleged leaks.

Diddy’s Children And Mother Attend Court Hearing To Support Him

Diddy and his legal team got a lot of updates during his latest federal court hearing in New York on Thursday (October 10), whether it was a potential trial start date or other motions from them. The Bad Boy mogul wasn’t just accompanied by his attorneys, though, as all of his children (seemingly except for near-two-year-old Love) and his mother Janice reportedly attended the hearing in support of Sean Combs. TMZ obtained footage of them walking out of the courtroom hand in hand after their father’s (or son’s) hearing concluded. As such, it seems like the Combs family wants to present a united front.

However, other important updates during this court session didn’t make it clear whether or not Diddy succeeded in his third bail attempt, which would presumably reunite him with his family for at least some time. The judge stated that the court did not receive this third motion at the time of the hearing, so they were not able to rule on it. However, the next court date is reportedly in December, and it’s unclear whether the court will address this bail attempt before this date or exactly on it. Nevertheless, the court proposed a May 5, 2025 start date, and Combs’ lawyer Marc Agnifilo reportedly agreed.

Diddy’s Family Leaving Court

Still, it’s unclear whether the court needs to confirm this start date for the Diddy trial or if their agreement already sets it in stone. Regardless, this federal case will develop as more civil allegations and accusations continue to emerge, such as recent claims from one of Cassie’s songwriters. Tiffany Red recently told ABC about an allegedly nasty phone call between the singer and Combs that she claims to have witnessed, as well as other alleged rifts.

Meanwhile, Diddy’s twin daughters D’Lila and Jessie, plus his mother Janice, reportedly paid him a jail visit recently. This means that, even if the third bail attempt doesn’t go through, it seems like the family will still have space to spend time together. Amid this federal case and slew of allegations, this must feel like some slight reprieve. We’ll see how else the Combs family reacts to all these allegations.

Cassie’s Songwriter Recalls Diddy’s Disturbing Alleged Phone Call With Singer

Diddy’s recent arrest and ongoing legal battle have prompted various individuals from his past to come forward to share their own alleged stories. One of these individuals, Cassie’s songwriter Tiffany Red, recently opened up about the experiences she allegedly had with him on ABC’s Secret Life of Diddy — A Special Edition of 20/20. She recalled one particularly chilling alleged phone conversation she heard Diddy and Cassie have, which tipped her off to the fact that something was off.

“Is someone in the car with you?” Red remembered Diddy allegedly asking Cassie, according to Us Weekly. “I know someone is in the car with you… That was my first time being, like, ‘Something is wrong.’” She went on to detail another disturbing alleged interaction, which she says took place in August of 2015, right around Cassie’s 29th birthday.

Red alleges that she saw Diddy get “in [Cassie’s] face,” cuss her out, and more while she was cornered in a room. It’s unclear what prompted the alleged explosion. “He was really mad, he was really close to her face and she just had her head down,” Red also alleged. “My sense was that everybody around him was afraid of him.”

These aren’t the only allegations Red has made against Diddy in recent months, however. In September, she also took to Instagram to share her reaction to his arrest. “While co-creating Cassie’s sophomore album, I was degraded by Sean Combs, deceived by him, his team, and the record labels about the music being released, I was exposed to Diddy’s abuse of Cassie and others in her circle, and I unknowingly consumed something laced without my consent at his Hombly Hills home studio while writing for Cassie back in 2017,” she alleged. Diddy To Remain In Jail, More Charges Still On The Table

Diddy and his legal team attended Manhattan federal court on Thursday (October 10) for their latest hearing, and it was a big one. Not only did the defense accept the judge’s offer for a May 2025 trial start date, but prosecutors also suggested that they could add more charges to the Bad Boy mogul’s original indictment given their still-ongoing investigation. Both teams agreed to refrain from speaking to the press moving forward, although the judge did not impose a gag order. Also, the prosecution denied defense attorney Marc Agnifilo’s claims that they leaked grand jury information to the press and are engaging in an unfair “takedown of a successful Black man.”

Back to the possible additional charges, though, this lines up with previous reports that a grand jury spoke to a sex worker allegedly linked to Diddy. However, perhaps the biggest update in the case is that the judge did not receive his third bail appeal, so they did not rule on it this time around. This means that Sean Combs will remain behind bars, and it’s unclear when the court will be able to rule on this bond attempt.

Despite all these developments, we imagine that the accusations against the prosecution that they allegedly leaked grand jury information might remain a contentious point in court. The Diddy case has so many civil allegations and federal accusations tied to it that the discourse against both sides is quite vocal. However, it’s impossible to make a full judgement call until we have a verdict from a court of law. As such, folks are still taking stock of pre-trial court developments more than anything else, especially when it comes to the specific charges against him.

Meanwhile, Diddy reportedly received an emotional prison visit recently from his twin daughters and his mother, so his family remains connected to him. Diddy’s Judge Offers Him Court Date For 2025 RICO Trial

We now have an idea of when Diddy’s federal trial for alleged sex trafficking could begin thanks to a Thursday (October 10) hearing. He went to Manhattan federal court to attempt to secure bail for a third time, and according to the Inner City Press, his judge offered him and his team a start date for his trial of May 5, 2025. Also, the judge clarified that he could move it to April, but Sean Combs’ lawyer Marc Agnifilo accepted the May start date. However, it’s unclear whether or not this set the start date in stone or if the court still has to officially confirm this date.

Nevertheless, prosecutors reportedly suggested to the judge that their case will last three weeks. In addition, the judge also set a discovery hearing for December 18, for which Diddy’s attorney requested a gag order over allegations that “agents have been leaking grand jury information and making other prejudicial statements.” Not only that, but federal prosecutors also hinted at future charges being added to the original indictment, since their investigation is still ongoing. Amid all this, we still don’t know the verdict on Puffy’s third bail attempt.

Judge’s Trial Start Date Offer For Diddy

This follows Diddy’s team’s recent accusations that federal authorities leaked the footage of him assaulting Cassie in a hotel room. They also called for an alleged misconduct investigation into the federal case, but it’s still unclear whether or not they hindered his chance at a fair trial. At press time, federal authorities have not issued a public statement on the matter, although we can presume they likely discussed this during today’s (Thursday, October 10) hearing. This joins other allegations around the case, including more lawsuits of alleged misconduct against the Bad Boy mogul.

Meanwhile, Diddy’s ex bodyguard Gene Deal recently claimed that Biggie Smalls’ mother Voletta Wallace cosigned his allegations after a supposed conversation that they had. Plenty of other celebrities and accusers have drawn alleged connections between Combs and other famous figures, and pretty much all of them are just allegations. Fortunately, it seems like the court of law is moving forward with his trial and will be able to reach solid conclusions in due time. As allegations continue, it seems like only this trial could separate fact from fiction.

As Diddy and his team continue to combat the federal case against them for alleged sex trafficking, others in the media are claiming his innocence. For example, Tokyo Toni recently took to social media with a wild freestyle about his situation after she covered herself in baby oil. It’s a pretty controversial and defensive set of bars, alleging that Sean Combs is just like the people accusing him of alleged abhorrent behavior: “a sinner h*e.” In addition, she accused federal authorities of deliberately tainting his public perception, and claimed that his accusers are just clout chasers who engage in the same type of alleged behavior.

Previously, Tokyo Toni’s alleged that folks are framing Diddy, and that the whole situation is targeting him unfairly. “”Free Puffy, free Puffy,” she expressed on Instagram Live. “We know what’s happening, the real ones. Yeah, free Puffy, get him on out of there, y’all. Why is everyone mad at Puffy? *laughs*.

Diddy’s Team Accuses Feds Of Leaking Cassie Assault Footage And Demands Alleged Misconduct Investigation

It’s no secret that Diddy has a long road ahead of him, and now, his legal team is accusing the feds of hindering his right to a fair trial. Yesterday (October 9), they filed a motion for an evidentiary hearing in the United States Court of the Southern District of New York, obtained by Meghann Cuniff. The hearing would investigate alleged government misconduct in the Bad Boy founder’s case. They accuse the feds of “strategic” and “unlawful” leaks, making “false and prejudicial statements” in the press, and more.

They even accuse the feds of leaking footage of Diddy assaulting Cassie at a hotel in 2016, which surfaced earlier this year. “The videotape was leaked to CNN for one reason alone,” Diddy’s motion alleges. “To mortally wound the reputation and the prospect of Sean Combs successfully defending himself against these allegations.”

Diddy’s Team Requests Evidentiary Hearing And More In New Motion

The motion also slams the raids conducted on Diddy’s mansions in March of this year, per AllHipHop. His team alleges that excessive force was used “to garner further press attention,” portray Diddy as “dangerous,” and more. On top of the evidentiary hearing, Diddy’s team is also pushing for “discovery of emails, documents and records in the possession of the government (including DHS) related to these leaks; a gag order prohibiting government personnel from disclosing any evidence or investigative material related to this case to any member of the media; and suppression of any evidence leaked by government employees in violation of Federal Rule of Criminal Procedure,” according to XXL.

Jodeci’s DeVante Swing Named Co-Defendant In Diddy Assault Lawsuit

DeVante Swing was arguably the most important member of Jodeci. He was the writer and producer behind the group’s biggest hits in the 90s. He was also an in-house producer for Uptown Records, the label Diddy worked for prior to founding Bad Boy. Diddy is credited with helping to refine Jodeci’s image as the rebelliousness alternative to Boyz II Men. Unfortunately, the mogul’s association has now landed DeVante Swing in hot water, legally speaking. He has been named as a new co-defendant in a lawsuit involving Diddy and fellow artist Aaron Hall.

Liza Gardner filed a lawsuit against Diddy and Aaron Hall back in November 2023. She alleged that she was sexually assaulted by both men in 1990, when she was only 16 years old. She claimed that they took advantage of her after providing her with alcohol at Hall’s house. Now, Gardner is adding DeVante Swing to the list of defendants. She alleges that Swing was not only at the residence where the alleged assault took place, but alleges that the Jodeci star was in the room with Diddy and Hall while it took place. The revised lawsuit was obtained by Rolling Stone, who provided crucial quotes.

DeVante Swing Allegedly Witnessed A Diddy Assault

“Unbeknownst to Ms. Gardner at the time,” the court documents read. “Defendant Swing was in the room when this assault took place and did not take any steps to prevent this abuse from occurring.” Another woman who claims to have been present for the alleged assault weighed in. She claimed the Jodeci singer was “leaning against the wall or furniture or something, watching whatever Puffy was doing to Liza.” The allegations become even more damning. Gardner claims that the artist was the person who brought her to Hall’s home in the first place.

She identified DeVante Swing as her “co-guardian” at the time, as she was a teenager and he was 21. She also claimed that the singer “had a duty to protect the child as her parents entrusted him with her safety.” The amended lawsuit further castigated DeVante Swing for “providing a child with alcohol, and marijuana and prostituting the child to his A&R Combs.” Swing has not responded to these allegations. The artist is currently on a European tour with Jodeci.

I have to have happiness within myself.” Jennifer Lopez didn’t mention Ben Affleck by name, but she did allude to the reason she felt the relationship had to ultimately come to an end. “You have to be complete,” she asserted to the outlet. “If you want something that’s more complete.” Lopez is happy with her decision, but she did not that it was not initially easy. Instead of romance, Lopez told the outlet that she wanted to focus on herself and her relationship with her children. This would mark a pretty radical change for Jennifer Lopez, in terms of public image. She has one of the most notable relationship track records of any celebrity in her age range. She’s dated Alex Rodriguez, as well as Diddy, and been married to Affleck and salsa superstar Marc Anthony. Naturally, her feelings on Diddy have soured in the wake of recent allegations.

Jennifer Lopez has not gone on the record to discuss the Diddy controversy. A source close to the singer, however, told Daily Star that she’s allegedly “disgusted” with what she has learned. “Among everything else that Jen is dealing with in her life,” the source claimed. “She is aware and has seen what Diddy did. “[She’s] not going to address the accusations or take time to talk about them because it is not her story to tell.” Lopez and Diddy dated from 1999 to 2001. Diddy’s Ideal Trial Date Revealed In New Joint Filing

Diddy’s legal battle appears to be just beginning, as the mogul was arrested last month and hit with various charges. He’s currently behind bars at the Metropolitan Detention Center in Brooklyn and has been denied release on bail two times already. Now, according to a new joint filing obtained by Meghann Cuniff, he’s looking to get his trial underway.

The filing from earlier today says that Diddy “intends to request a trial date in April or May 2025.” It also states that he plans to file “a motion for a hearing and other remedies related to unauthorized and prejudicial leaks of grand jury information.” The filing arrives shortly after Diddy was hit with even more disturbing allegations, outlined by attorney Ariel Mitchell-Kidd earlier this week.

Mitchell-Kidd alleges that her client was sexually assaulted by Diddy, his bodyguard, and another man at the mogul’s home. “[My client] was raped by Mr. Combs, his bodyguard, and another man,” she alleged in an interview with News Nation. “They invited her to Combs’ home and orchestrated this entire situation. The upcoming lawsuit outlines her traumatic flight to safety after that horrific night.” Mitchell-Kidd also alleges that an unknown oily substance was poured on her client during the alleged attack.

“She initially thought it was acid,” she alleged. “Her body went limp, and she couldn’t understand why. Earlier in the evening, she drank some water that tasted off.
