Jussie Smollett Loses Appeal, Vows To Take Case To The Supreme Court

Jussie Smollett has lost his appeal for fabricating a violent hate crime against himself. An appeals panel ruled 2-1 against Smollett, meaning his original 150-day prison sentence will be upheld. However, Smollett announced in the hours after the verdict that he wasn’t done fighting. “We wish to highlight that the decision was divided, with Justice Lyle offering a detailed analysis in favor of Smollett. We are preparing to escalate this matter to the Supreme Court, armed with a substantial body of evidence,” a representative for Smollett said.

While he waited on his verdict, Smollett entered rehab. Representatives for Jussie Smollett have told TMZ that the actor entered rehab in mid-October to address unspecified issues. “Jussie has had an extremely difficult past few years. He has quietly been working very hard for some time now and we are proud of him for taking these necessary steps,” a statement from his team read. Furthermore, the outlet was told that Smollett is in an outpatient program. However, many viewed the move as an attempt to garner sympathy ahead of his appeal verdict.

Jussie Smollett Heads To Rehab For Unspecified Issues

Representatives for Jussie Smollett have told TMZ that the actor has entered rehab to address unspecified issues. “Jussie has had an extremely difficult past few years. He has quietly been working very hard for some time now and we are proud of him for taking these necessary steps,” a statement from his team read. Furthermore, the outlet was told that Smollett is in an outpatient program.

The move comes amid Smollett’s ongoing appeal over the 2021 guilty verdict in his criminal case. Smollett was sentenced to 150 days in prison for fabricating a hate crime. The actor claimed that he was attacked by two masked Trump supporters who physically assaulted him and placed a noose around his neck. However, the men in question testified at Smollett’s trial that he had paid them to help stage the attack. Smollett, who served six days of his sentence, is appealing the verdict. A court date has been set for December following five continues of the appeal.

Additionally, the rehab move likely puts a pause on Smollett’s current film project. As reported earlier this year, Smollett is seemingly set to make his directorial debut. Little is known about The Lost Holiday. However, set photos obtained by TMZ show that Vivica A. Fox is set to star. The two previously worked together on the TV show Empire. Furthermore, Fox has been a vocal supporter of Smollett, even after he was found guilty of the hoax.

If the project makes it to release, it will be Smollett’s first involvement in a motion picture since 2017. Smollett made two on-screen appearances that year – as Ricks in Alien: Covenant and as poet Langston Hughes in the biopic Marshall. However, Smollett has been a persona non grata in Hollywood after he was written out of the final season of Empire following the reveal of his hoax.

Jussie Smollett Sentenced to 150 Days in Cook County Jail & Probation for Hate Crime Hoax

Jussie Smollett is no longer in the psychiatric ward of Cook County Jail. According to TMZ, a Cook County Sheriff’s office representative states, Smollett was moved because his cell was needed for another person.

“Mr. Smollett’s housing unit was changed Monday to a different cell within Division 8,” the rep said. “He was moved from that cell because Cermak Health Services needed his cell for another detained person. This was a decision made by the medical professionals. Mr. Smollett was never restrained to a bed or anything else in the cell. The bed was never equipped with restraints.”

The rep added, “Mr. Smollett remains housed in his own cell with officers stationed at the open door to his cell to ensure that he is under direct observation at all times. As with all detained persons, Mr. Smollett is entitled to have substantial time out of his cell in the common areas on the tier where he is housed.”

The Sheriff’s representative statement counters one made by his brother Jocqui Smollett, who visibly is out front of the “Free Jussie” movement. Jocqui called the move a big push forward, caused by the public backlash. “Cook County doesn’t really move until they get bad publicity … keep continuing to call Cook County Jail checking in on him and keep saying that you believe he should be free.”
